AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN
OF FOUNTAIN HILLS. ARIZONA, PROHIBITING THE PLACING OF
UNATTENDED CONTAINERS FOR SOLICITING DEPOSIT OF RECYCLABLE
MATERIALS OR DONATED ITEMS EXCEPT IN CONFORMANCE WITH THE
PROVISIONS HEREOF: AMENDING CHAPTER 10 OF THE FOUNTAIN HILLS
TOWN CODE BY ADDING THERETO A NEW ARTICLE 10-5 AND PROVIDING
PENALTIES THEREFOR.
BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF
FOUNTAIN HILLS. ARIZONA AS FOLLOWS:
SECTION 1. That Chapter 10 of the Fountain Hills Town Code is amended
by adding thereto a new ARTICLE 10-5 to read as follows:
"ARTICLE 10-5 UNATTENDED CONTAINERS:
® No person shall _place. display or maintain any unattended container for
soliciting_ deposit of recyclable materials or donated items in any exterior
location within the Town limits, except in conformance with all of the
following provisions:
A. Such unattended containers may be located only within the
parking lot of private property lawfully zoned, developed and used
for commercial or industrial purposes or at schools. churches or
charitable organizations which have similar parking facilities.
B. Such unattended containers may be located only with the
permission of the property owner, his agent. or the person in
possession of the _property, and the container owner's name and
current telephone number shall be displayed thereon in a
conspicuous location.
C. The owner of such unattended container and the property owner
shall iointly or severally maintain all exterior areas within twenty-
five (25) feet of the container free from litter."
SECTION 2. PENALTY: That any person who shall violate any of the
® provisions of this ordinance or of the Fountain Hills Town Code as amended
herein shall be euilty of a misdemeanor and upon conviction thereof shall
be punished as provided in Article 1-8 of the Fountain Hills Town Code.
