HomeMy WebLinkAboutOrd 1992-07JS ® ORDINANCE 92-07 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING THE OFFICIAL ZONING MAP OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AND THE TEXT OF THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS, ARIZONA PURSUANT ARTICLES XXVII AND XXXI OF THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS, IN THE AREA COMMONLY KNOWN AS "FIREROCK ESTATES", CASE #92-01. BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS: Section 1. Article XXXI, Section 31.1 of the Zoning Ordinance for the Town of Fountain Hills authorizes amendments Zoning Ordinance. Article XXVII, Section 27.3 permits Residential Unit Plans of Development. The text of the Zoning Ordinance of the Town of Fountain Hills is hereby amended for the Firerock Estates (Case #92-01) by keeping all the regulations for a R1-35 Zoning District, except the following: ® 1. The undulating earthen berm along the eastern portion of the plat (Lots 66, 56, 57, 42, 43, 44 and 45) be constructed prior any future construction in this project area or six (6) months, whichever comes first. 2. Staff review of all lots developed on Saguaro Boulevard to assure driveway configuration that will avoid vehicular backing onto Saguaro Boulevard. 3. The G. William Larson and Associates building and site (Lot 22, Plat 414; address 16212 Red Mountain Trail) be converted to a residential house and site by January 1, 1995. 4. The minimum lot size requirement remain at 35,000 square feet and the lots 10, 11, 19, and 20 be non -conforming lots sizes. 5. Minimum front yard set back requirements for lots 10, 11, 15, 16, 19, and 20 is 20 feet. 6. Minimum rear yard set back request for lots 10, 11, 15, 16, 19, and 20 is 20 feet. 7. Minimum distance between buildings is 10 feet. �I ct ® Section 2. Article XXXI, Section 31.1 of the Zoning Ordinance for the Town of Fountain Hills authorizes amendments to the Zoning Ordinance. Article XXVII, Section 27.3 permits Residential Unit Plans of Development. The Zoning Map of the Zoning Ordinance of the Town of Fountain Hills is hereby amended for the Firerock Estates area (Case #92-01) in the following ways: a. The land area included lots and adjoining street rights -of -way in Plat 414, Lots 8 through 25 from a "Commercial Office" zoning district to "R1-35 Residential Unit Planned Development #92-01" zoning district; b. Plat 414, Lot 26, be amended from "(C-1) Neighborhood - Commercial Zoning District to R1-35 Residential Unit Planned Development #92-01 C. Plat 414, Lots 28 through 45, and Lots 56 through 66; be amended from "IND-2 LU.P.D. #Z86-58 and #Z88-55" to "R1-35 R.U.P.D. #Z92-01".
