AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA, AMENDING THE TEXT OF THE ZONING ORDINANCE OF THE
TOWN OF FOUNTAIN HILLS PURSUANT TO ARTICLE XXXI OF THE ZONING ORDINANCE
FOR THE TOWN OF FOUNTAIN HILLS, BY REVISING ARTICLE XL PLANNED SHOPPING
PLAZA OVERLAY DISTRICT AMENDING SECTION 40.8 AND ADDING SECTION 40.9 USES
SUBJECT TO SPECIAL USE PERMITS.
BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN
HILLS, ARIZONA AS FOLLOWS:
Section 1. Article XXXI, Section 31.1 of the Zoning Ordinance for the Town of Fountain Hills
authorizes amendments to the Zoning Ordinance. The Ordinance of the Town of
Fountain Hills is hereby amended by revising Article XL, Planned Shopping Plaza Overlay
District as follows:

A. Ezce 't:as otherwise- ..- Ided,1 ail activity associated with any use including
accessory storage and display areas, shall be conducted within a
completely enclosed building. Loading and unloading activities and
activities otherwise specifically authorized are exempt from this regulation.
40.9 Additional Uses Subiect to Special Use Permits.
Limited outdoor display area as an accessory to an established permitted
or special permitted use subject to:
a. Outdoor display must be completely under a roof. Said roof must be
a permanent roof conforming to the adopted building code.
b. The roof structure Is to be functionally attached to and Integrated
with the primary building within the buildable lot area.
C. The detail of the roof structure of the outdoor display area should
continue the character or theme of the primary building.

d. The outdoor display area is to be contained entirely on the lot(s)
owned or leased by the applicant.
e. Equipment such as, but not limited to, vending machines and Ice
machines should be screened from public view and placed In an
area designed for their use, as an Integral part of the project.
A minimum ten percent (10`10) of the lot used for an outdoor display
shall be devoted to landscaping.
