HomeMy WebLinkAboutOrd 1993-12ORDINANCE NO. 93 - ]:,L AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING THE TOWN CODE OF FOUNTAIN HILLS, ARIZONA, BY AMENDING SECTION 2-1-1 ELECTED OFFICERS AND SECTION 2-2-1 SELECTION OF MAYOR, DEALING WITH DIRECT ELECTION OF THE MAYOR; AMENDING ORDINANCE 92-05 AND PROVIDING SEVERABILITY. Whereas, Ordinance 92-05 provided for the direct election of the Mayor of the Town of Fountain Hills, Arizona, and that the measure be put before the qualified voters of the Town; and Whereas, the qualified electors of the Town of Fountain Hills, Arizona did pass, by majority vote at the Town special election held on November 3, 1992, the measure providing for direct election of the Mayor of the Town of Fountain Hills, Arizona, commencing with the primary and general election of the Town in 1994. NOW THEREFORE BE IT ORDAINED by the Mayor and Council of the Town of Fountain Hills, Arizona: Section I: The Code of the Town of Fountain Hills, Arizona is hereby amended by amending Section 2-1-1 Elected Officers, to read as follows: Text of section effective until June 1, 1994 Section 2-1-1 Elected Officers ® The elected officers of the town shall be seven councilmembers, one of whom shall be designated as mayor in accordance with Section 2-2-1. The mayor and councilmembers shall constitute the council and shall continue in office until assumption of duties of office by their duly elected successors. Councilmembers shall serve four year overlapping terms. Text of section effective on June 1, 1994 Section 2-1-1 Elected Officers A. The elected officers of the town shall be a mayor and six councilmembers. The mayor and councilmembers shall constitute the council and shall continue in office until assumption of duties of office by their duly elected successors. B. The term of office of the mayor shall be two years. C. Councilmembers shall serve four year overlapping terms. Section II: The Code of the Town of Fountain Hills, Arizona is hereby amended by amending Section 2-2-1 Selection of Mayor, to read as follows: Section 2-2-1 Selection of Mayor ® The councilmembers shall at the first regular meeting after the general election choose a mayor from among their number who will serve at the pleasure of the council; provided that beginning with the town election in 1994, the mayor shall be directly elected by the qualified electors of the town. Section III: Section I of Ordinance 92-05 is hereby amended to reference Section 2-1-1 of the town code. (01 Section IV: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
