ORDINANCE #94-05
AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING THE TEXT OF
THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS,
ARIZONA AND PURSUANT TO CHAPTER 2, SECTION 2.01 OF THE
ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS, BY
AMENDING THE OFFICIAL ZONING DISTRICTS MAP OF THE TOWN
OF FOUNTAIN HILLS.
WHEREAS The Town of Fountain Hills adopted Ordinance #93-22, on November 18, 1993,
which adopted the Zoning Ordinance for the Town of Fountain Hills; and
WHEREAS Chapter 2, PROCEDURES. Section 2.01, Amendments or Zone Changes.
® establishes the authority and procedures for amending the zoning district
boundaries; and
WHEREAS Chapter 3 ESTABLISHMENT OF ZONING DISTRICTS AND
BOUNDARIES THEREOF, Section 3.02 Boundaries Lines on the Zoning
Districts Maps. establishes the "Official Zoning Districts Map'; and
WHEREAS Public hearings were advertised in the March 9, 1994, March 16, 1994, March 23,
1994 and April 6, 1994 editions of The Times of Fountain Hills and Rio Verde,
pursuant to Arizona Revised Statutes §9-462.04, and
WHEREAS Public hearings were held by the Fountain Hills Planning and Zoning Commission
on March 24, 1994 and the Mayor and Common Council on April 7, 1994; and
WHEREAS The Future Land Use Plan in the "Fountain Hills General Plan" designates Lots
7-21, Block 1, Plat 601-A, as a Single-Family/Medium area; and
WHEREAS The predominant character of the Sunflower Drive neighborhood where Lots 7
through 21, Block 1, Plat 601-A, is located, is single-family residential on lots in
the 10,000 square feet or greater range.

11.03 Uses Subject to Special Use Permit in an R-3; 114i6d R-5 Zoning District are as
follows:

for an C-1 Zoning District are applicable for a hotel/motel use in an R-5 Zoning District.
