HomeMy WebLinkAboutOrd 1994-12® ORDINANCE NO. 94-12 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING THE FOUNTAIN HILLS TOWN CODE CHAPTER 2 MAYOR AND COUNCIL, ARTICLE 2-61NITIATIVE AND REFERENDUM, BYAMENDING SECTION 2-6-1 ALLOWING THE CALLING OF A SPECIAL ELECTION FOR REFERENDUM. BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS AS FOLLOWS: Section 1. That Chapter 2, Article 2-6, Section 2-6-1 of the Town Code is hereby amended to read as follows: Section 2-6-1 Power Reserved: Time Of Election A. There is reserved to the qualified electors of the Town the power of initiative and the referendum as prescribed by the State Constitution, Arizona Revised Statues and this Town Code. B. Any proper initiative matter shall be voted on by all qualified electors at the ® next ensuing Town of Fountain Hills primary or general election pursuant to Section 2-6-3 A. C. That upon presentation of a certificate to the Town Council by the Town Clerk that all steps required by the Constitution and the State Statutes concerning referendum have been complied with the Town Council may call a special election on the matter or matters referred no less than (90) days and no more than (150) days from the presentation of the certificate by the Town Clerk; provided that within that period of time there is no regularly scheduled Town primary or general election for which the referendum matters would otherwise qualify. D. The call of a special election for referendum matters shall be valid only upon the affirmative vote of four members of the Town Council voting on said request and call. Should the required number of votes to call the special election not be obtained then the referendum matter shall appear on the ballot at the next regular Town primary or general election. E. If a special election on a referendum matter is called for by the Town Council pursuant to paragraph D above, then in addition to all other notices required by law the Town Clerk shall notify the person (s) and or organization that requested the referendum petition of the Council decision by first class mail postage prepaid at the address shown upon the request for referendum petition number. Ll ® F. The provisions of this section shall apply to all referendum matters whether or not the petitions have already been presented to the Town Clerk and it is the intention of the Council that this ordinance be retroactive in nature as to any and all referendum petitions in existence at the time of this amendment to the Code.
