HomeMy WebLinkAboutOrd 1994-15® ORDINANCE NO 94-15 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA APPROVING THE APPOINTMENT OF ALL JUDGES OF THE FOUNTAIN HILLS MUNICIPAL COURT AS JUVENILE HEARING OFFICERS; AMENDING CHAPTER 5 MUNICIPAL COURT ARTICLE 5-2 OFFICERS, POWERS AND DUTIES SECTION 5- 2-4 POWERS AND DUTIES OF THE TOWN MAGISTRATE BY ADDING A NEW PARAGRAPH G; AND DECLARING AN EMERGENCY. WHEREAS, under A.R.S. §8-232, as amended by Laws 1994, Ch. 209,§4, effective July 17, 1994, a juvenile hearing officer may process, adjudicate and dispose of cases in which a child under the age of eighteen years on the date of the alleged offense is charged with violating certain laws; and WHEREAS, the presiding judge of the juvenile court in Maricopa County is authorized to appoint municipal judges to serve as juvenile hearing officers subject to the approval of the Town Council and WHEREAS, the presiding judge of the juvenile court in Maricopa County ® desires to appoint all judges of the Fountain Hills Municipal Court to serve as juvenile hearing officers, and the Town of Fountain Hills Council is willing to approve the appointment of such judges as juvenile hearing officers; NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, as follows: SECTION 1. That the appointment by the presiding judge of the juvenile court in Maricopa County of all judges of the Town court, regular and pro tempore, to serve as juvenile hearing officers, is hereby approved. SECTION 2. That the Town Code Chapter 5 Municipal Court Article 5-2 Officers Powers and Duties Section 5-2-4 Powers and Duties of the Town Magistrate is hereby amended by adding a new paragraph lettered G and reading as follows: G. The magistrate shall serve as juvenile hearing officer if appointed by the presiding judge of the juvenile court for Maricopa County. SECTION 3. WHEREAS, the immediate operation of the provisions of this Ordinance is necessary for the preservation of the public peace, health, and safety, an EMERGENCY is hereby declared to exist, and this Ordinance shall be in full force and effect from and after its passage by the Council as required by the Town Code, and is is hereby exempted from the referendum. ® PASSED AND ADOPTED by the Council of the City of Fountain Hills this 7th day of July, 1994.
