HomeMy WebLinkAboutOrd 1995-09ORDINANCE 95-09 ® AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS PURSUANT CHAPTER 2, SECTION 2.01, BY AMENDING CHAPTER 5, GENERAL PROVISIONS, SECTION 5.11, LAND DISTURBANCE STANDARDS, SUBSECTION B. GRADING STANDARDS, PARAGRAPH 3.GRADING OF INDIVIDUAL PLATTED LOTS; CHAPTER 7 PARKING AND LOADING REQUIREMENTS; SECTION 7.03 DESIGN AND LOCATION OF PARKING SPACES, SUBSECTION A. SINGLE-FAMILY RESIDENCES, MOBILE HOMES, AND MULTI -FAMILY RESIDENCES OF FOUR (4) OR LESS DWELLING UNITS, PARAGRAPH 1 LOCATION; CHAPTER 7 PARKING AND LOADING REQUIREMENTS; SECTION 7.04 SCHEDULE OF REQUIRED OFF-STREET SPACES, PARAGRAPH F. SCHEDULE; CHAPTER 10 SINGLE-FAMILY RESIDENTIAL ZONING DISTRICTS: R-190, R143, R1-35, R1-35H, R1-18, R1-10, RI-10A, R1-8, RI-8A, R1-6, R1-6A, SECTION 10.03 USES SUBJECT TO TEMPORARY USE PERMIT, SUBSECTION C MODEL HOMES; CHAPTER 11 MULTI -FAMILY RESIDENTIAL ZONING DISTRICTS, R-2, R-3, R-4 and R-5, SECTION 11.04 USES SUBJECT TO TEMPORARY USE PERMIT; SUBSECTION C. MODEL HOMES, PARAGRAPH 3; CHAPTER 12 COMMERCIAL ZONING DISTRICTS, SECTION 12.02 PERMITTED USES, SUBSECTION D.; AND CHAPTER 12 COMMERCIAL ZONING DISTRICTS, SECTION 12.05. ® WHEREAS Chapter 2, PROCEDURES. Section 2.01, Amendments or Zone Changes. establishes the authority and procedures for amending the zoning ordinance; and WHEREAS The Town of Fountain Hills advertised public notices of a size that were one - eighth page or greater in size, in the official newspaper of general circulation, the Times of Fountain Hills and Rio Verde, on February 22, March 1, 8, and 15, 1995 of public hearings held by the Fountain Hills Planning and Zoning Commission on March 9, 1995 and by the Fountain Hills Town Council on March 16, 1995, to invite comments from the public; and WHEREAS The Town desires to better regulate land disturbances in residentially zoned areas; and WHEREAS The Town desires to establish minimum off-street parking standards for model home uses; and WHEREAS There is a need to clearly permit mini -storage facilities in heavy commercial areas of Town; and WHEREAS Automotive sales and services uses are appropriate in intermediate commercially zoned areas with certain conditions; ® Ordinance #95-09 1 of 5 NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL �l OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS: Section 1. CHAPTER 5 GENERAL PROVISIONS, of the Zoning Ordinance for the Town of Fountain Hills, Section 5.11 Land Disturbance Standards, shall be amended as follows with the shaded areas showing additions to the current text and the strike -out areas showing deletions from the current text 5.11 Land Disturbance Standards B. Grading Standards 3. Grading of Individual Platted Lots. In all residential zoning districts the extent of disturbance on a lot, plans for- a single kffagy residential use is meeived shall be limited to either of the following: (Lots__ owned .by. u._!y Section 2. CHAPTER 7 PARKING AND LOADING REQUIREMENTS, Section 7.03 is of the Zoning Ordinance for the Town of Fountain Hills shall be amended to establish the locational provisions for the location of parking lots for model homes and to establish the minimum parking requirements for model homes, as follows: (The shaded areas indicate additions and the strike -out areas indicate deletions) 7.03 Design and Location of Parking Spaces. ® Ordinance #95-09 A. Single -Family Residences, Mobile Homes, and Multiple -Family Residences of Four (4) or Less Dwelling Units. 1. Location: Required off-street parking shall be located on the same lot or parcel as the use it is intended to serve. 2 of 5 Section 3. CHAPTER 7 PARKING AND LOADING REQUIREMENTS, Section 7.04 ® of the Zoning Ordinance for the Town of Fountain Hills shall be amended to establish the locational provisions for the location of parking lots for model homes and to establish the minimum parking requirements for model homes, as follows: (The shaded areas indicate additions and the strike -out areas indicate deletions) 7.04 Schedule of Required Off -Street Spaces. CHAPTER 10 SINGLE-FAMILY RESIDENTIAL ZONING DISTRICTS: R-190, R1-43, R1-35, RI-35H, RI-18, R1-10, Rl-10A, R1-8, RI-8A, R1-6, RI-6A, Section 10.03 of the Zoning Ordinance for the Town of Fountain Hills shall be amended to establish the minimum parking requirements for model homes, as ® follows: (The shaded areas indicate additions and the strike -out areas indicate deletions) 10.03 Uses Subject to Temporary Use Permit: C. Model Homes. Model Homes may be permitted in a residential area by Temporary Use Permit only. In the review for a model home, the staff, and if necessary, the Town Council, may consider lighting, landscaping, hours of operation, signage, parking, duration, and neighborhood impact. CHAPTER 11 MULTI -FAMILY RESIDENTIAL ZONING DISTRICTS, R-2, R- 3, R-4 and R-5, Section 11.03 of the Zoning Ordinance for the Town of Fountain Hills shall be amended to establish the minimum parking requirements for model homes, as follows: (The shaded areas indicate additions and the strike- out areas indicate deletions) 11.03. Uses Subject to Temporary Use Permit: C. Model Homes. Model Homes may be permitted in a residential area by Temporary Use Permit only.
