HomeMy WebLinkAboutOrd 1995-11`J ORDINANCE 95-11 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS PURSUANT CHAPTER 2, SECTION 2.01, BY AMENDING CHAPTER 5, GENERAL PROVISIONS. SECTION 5.11 LAND DISTURBANCE STANDARDS, SUBSECTION B. GRADING STANDARDS, PARAGRAPH 2. GRADING OF UNPLATTED LAND TO INCLUDE CHAPTER 5, GENERAL PROVISIONS. SECTION 5.11 LAND DISTURBANCE STANDARDS, SUBSECTION C. CUT AND FILL STANDARDS, BY REFERENCE AS PART OF PARAGRAPH 2. WHEREAS Chapter 2, PROCEDURES. Section 2.01, Amendments or Zone Changes. establishes the authority and procedures for amending the zoning ordinance; and WHEREAS The Town of Fountain Hills advertised public notices of a size that were one - eighth page or greater in size, in the official newspaper of general circulation, the Times of Fountain Hills and Rio Verde, on March 29, April 5, 12, and 19, 1995 of public hearings held by the Fountain Hills Planning and Zoning Commission on April 13, 1995 and by the Fountain Hills Town Council on April 20, 1995, to invite comments from the public; and ® WHEREAS The Town desires to better regulate land disturbances in residentially zoned areas; and WHEREAS -The Town desires to include the cut and fill limitation standards, the revegetation standards, and the other standards contained in Chapter 5, Section 5.11.C. of the Zoning Ordinance for the Town of Fountain Hills in the regulations governing the grading of unplatted land; and NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS: Section 1. Chapter 5 of the Zoning Ordinance for the Town. of Fountain Hills shall be amended to expand Section 5.11 Land Disturbance Standards, Subsection B. Grading Standards, Paragraph 2. Grading of Unolatted Land, to include Subsection C. Cut and Fill Standards, of Section 5.11, by reference as part of this paragraph. Specifically, the amendment is as follows: (The shaded area indicates the addition and the strike -out area indicates the deletion) is Ordinance 95-11 1 of 2 Pv..b1;AttL F-O.Tirnw 4-alq-QS E-3 - qS CHAPTER 5 GENERAL PROVISIONS 5.11 Land Disturbance Standards B. Grading Standards. 2. Grading of Unolatted Land. Subject to the restrictions of paragraphs B C through G of this section, the area permitted to be disturbed on any unplatted land within residential zoning districts, is unlimited on terrain sloping less than fifteen percent (15%). Disturbance on slopes equal to or exceeding fifteen percent (15%) is limited to the percentage equivalent to the "lot coverage percentage" prescribed in the zoning district.
