AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING
THE FOUNTAIN HILLS TOWN CODE CHAPTER 7, BUILDING
AND BUILDING REGULATIONS; CHAPTER 11 OFFENSES
AND CHAPTER 15 SUBDIVISIONS TO PROVIDE FOR A
VOLUNTARY FIRE SPRINKLER PROVISION IN NEW
SUBDIVISIONS.
BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. That the Town Council of the Town of Fountain Hills hereby finds that the
opportunity to include fire sprinklers in new subdivisions, platted after the date of this
Ordinance, is of benefit to the community and serves well the public health, safety and
welfare.
Section 2. That the Town Engineer and the Community Development Director are
hereby authorized and directed to establish and provide all of the necessary forms and
procedures to allow a new subdivision to adopt a policy of mandatory fire sprinklers at
the time of subdivision platting.
is Section 3. That the Town Code, Chapter 7, Buildings and Building Regulations, Article
7-1, Technical Codes Sections 7-1-1 A.4. is hereby amended by including a new
subsection 7-1-1 A.4.a to read as follows:
Appendix III. B of the 1988 Uniform Fire Code is amended by adding the following
paragraph to paragraph #2, at page 426:
Where all structures requiring building permits are required to be fire
sprinkled, hydrant spacing may be reduced to 1,000 feet in all single
family and two family zoning districts; and may be reduced to 700
feet in all commercial and industrial zones.
Section 4. That the Town Code Chapter 11, Offenses, Article 11-1 Offenses, is hereby
amended by adding a new Section 11-1-16 to read as follows:
FIRE SPRINKLED RESIDENCES AND BUILDINGS. It shall be an offense which
upon conviction, shall be punishable as a Class 1 misdemeanor for the owner,
tenant, occupant for any other person of a building or structure located in a sub-
division for which mandatory sprinklers have been approved to disable or disarm
any fire sprinkler or fire sprinkler apparatus, so that said apparatus is not capable
of functioning under all normal conditions.

Section 5. That the Town Code Chapter 15, Sub -divisions, Article 15-1, Town of
Fountain Hills Subdivision Ordinance is hereby amended to read as follows:
Section 303. Streets and Highways: Suggested Street Cross, Sections is hereby
amended by adding the following text between paragraphs 2 & 3 thereof.
Residential streets may be 26 feet in width as measured from back to back of the
curb where the subdivision has been approved as requiring fire sprinklers; and
there is a maximum 10 tributary lots on the street.
This reduction in street width is not applicable in any zones other than R1-35, R1-
43 and R-190, zoning districts; or where on -street parking is prohibited; or where
equivalent measures acceptable to the Town Engineer are utilized.
Section 6. That the Town Code, Chapter 15 Subdivisions, Article 15-1, Town of
Fountain Hills Subdivision Ordinance, is hereby amended by adding the following note
to Plate 10 of Section 304, street and block design:
When the Town has approved a subdivision requiring fire sprinklers, cul-de-sacs
should preferably not be longer than 1,500 feet or provide frontage for more than
25 lots and should terminate in a turnaround at the closed end.
The cul-de-sac may have an additional length of 2,000 feet for up to 20 additional
lots, if there is a divided roadway with a raised median.
