AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS, ARIZONA, PURSUANT TO CHAPTER 2,
SECTION 2.01 OF THE ZONING ORDINANCE FOR THE TOWN OF
FOUNTAIN HILLS, AMENDING THE OFFICIAL ZONING DISTRICTS
MAP OF THE TOWN OF FOUNTAIN HILLS, ARIZONA BY
DESIGNATING AN 8.70 ACRE PARCEL OF LAND, AS SHOWN IN
EXHIBIT "A" AND AS DESCRIBED IN EXHIBIT "B", FROM THE "RI-
8", SINGLE-FAMILY RESIDENTIAL ZONING DISTRICT - 8,000
SQUARE FEET PER DWELLING UNIT, THE "R1-35", SINGLE-FAMH.Y
RESIDENTIAL ZONING DISTRICT - 35,000 SQUARE FEET PER
DWELLING UNIT, AND THE "R1.4311, SINGLE-FAMILY RESIDENTIAL
ZONING DISTRICT - ONE ACRE PER DWELLING UNIT TO THE 11R1-
35H11, SINGLE-FAMILY RESIDENTIAL HILLSIDE ZONING DISTRICT -
35,000 SQUARE FEET PER DWELLING UNIT.
WHEREAS, The Town of Fountain Hills adopted Ordinance #93-22, on November 18, 1993,
which adopted the Zoning Ordinance for the Town of Fountain Hills; and,
WHEREAS, Chapter 2, PROCEDURES. Section 2.01, Amendments or Zone Changes.
establishes the authority and procedures for amending the zoning district
boundaries; and,
WHEREAS, Chapter 3, ESTABLISHMENT OF ZONING DISTRICTS AND
BOUNDARIES THEREOF. Section 3.02 Boundary Lines on the Zoning
District Maps establishes the "Official Zoning District Maps"; and,
WHEREAS, Public hearings were advertised in the April 5, 1995, April 12, 1995, and the April
19, 1995 editions of The Times of Fountain Hills and Rio Verde, pursuant to
Arizona Revised Statutes §9-462.04, and,
WHEREAS, Public hearings were held by the Fountain Hills Planning and Zoning Commission
on March 23, 1995 and by the Mayor and Common Council on April 20, 1995;
and,

WHEREAS, The Future Land Use Plan in the "Fountain Hills General Plan" designates all of
® the 8.70 acre parcel of land, as shown in Exhibit "A" and as described in Exhibit
"B" for "Single -Family Medium" and "Single -Family Low" land uses.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. The "Official Zoning District Maps" shall be amended to change the Zoning
District Designation of the 8.70 acre parcel of land, as shown in Exhibit "A" and
as described in Exhibit "B", from the "R1-8", Single -Family Residential Zoning
District - 8,000 Square Feet Per Dwelling Unit, the "R1-35", Single -Family
Residential Zoning District - 35,000 Square Feet Per Dwelling Unit, and the "Rl-
43", Single -Family Residential Zoning District - One Acre Per Dwelling Unit to
the "Rl-35H", Single -Family Residential Hillside Zoning District - 35,000 Square
Feet Per Dwelling Unit.
PASSED AND ADOPTED BY the Mayor and Common Council of the Town of Fountain Hills,
Arizona, this 20th day of April, 1995.

A portion of Section 21, Township 3 North, Range 6 East of the
Gila and Salt River Base and Meridian, Maricopa County, Arizona,
more particularly described as follows:
BEGINNING at the most easterly corner of Fountain Hills Arizona
Final Plat No. 605-C as recorded on July 17, 1973 in Book 164, Page
14 of the records of Maricopa County, said point being a point on
a curve on the westerly right of way line of Fountain Hills
Boulevard, said curve being concave easterly and having a radius of
855.00 feet, a radial line passing through said point bears North
72 degrees 54 minutes 47 seconds West; thence southerly along the
arc of said curve and said right of way through a central angle of
11 degrees 59 minutes 41 seconds an arc length of 178.99 feet;
thence departing said right of way, North 87 degrees 33 minutes 20
minutes West a distance of 200.00 feet; thence North 71 degrees 34
minutes 08 seconds West a distance of 285.00 feet; thence North 50
degrees 00 minutes 00 seconds West a distance of 364.85 feet;
thence North 16 degrees 05 minutes 01 seconds West a distance of
261.46 feet to the most easterly corner of Fountain Hills Arizona
Final Plat No. 701 as recorded on August 14, 1984 in Book 271, Page
27 of the records of Maricopa County; thence continuing North 16
degrees 05 minutes 01 seconds west along said plat boundary a
distance of 185.30 feet; thence North 54 degrees 00 minutes 06
seconds West along said boundary a distance of 172.81 feet; thence
® North 05 degrees 17 minutes 18 seconds West a distance of 240.00
feet; thence North 47 degrees 20 minutes 00 seconds East a distance
+ of 125.00 feet to the southwesterly right of way line of Buffalo
Drive and the southerly boundary of aforementioned Plat No. 605-C;
thence departing the boundary of Plat No. 701, South 42 degrees 40
minute 00 seconds East along said right of way and the boundary of
Plat No. 605-C a distance of 439.42 feet to the beginning os a
tangent curve concave southerly and having a radius of 375.00 feet;
thence along the arc of said curve through a central angle of 18
degrees 05 minutes 00 seconds an arc length of 118.36 feet; thence
South 24 degrees 35 minutes 00 seconds East a distance of 392.05
feet to the beginning of a tangent curve concave northerly and
having .a radius of 325.00 feet; thence along the arc of said curve
through a central angle of 40 degrees 58 minutes 27 seconds an arc
length of 232.42 feet to a point of reverse curve, said curve being
concave southerly and having a radius of 45.00 feet; thence along
the arc of said curve through a central angle of 35 degrees 03
minutes 41 seconds an arc length of 27.54 feet to a point of
reverse curve, said curve being concave northerly and having a
radius of 45.00 feet; thence along the arc of said curve through a
central angle of 130 degrees 45 minutes 14 seconds an arc length of
102.69 feet; thence South 71 degrees 14 minutes 57 seconds East a
distance of 199.66 feet to the POINT OF BEGINNING
