AN ORDINANCE OF THE MAYOR AND COMMON
COUNCIL OF THE TOWN OF FOUNTAIN HILLS,
ARIZONA AMENDING THE TOWN CODE CHAPTER 16,
STREETS AND SIDEWALKS, ARTICLE 16-1,
ENCROACHMENTS, SECTION 16-1-3, OTHER
EXCEPTIONS TO PERMIT REQUIREMENTS, BY ADDING
SECTION 16-1-3.E, EXEMPTING ENCROACHMENT
PERMITS FOR ADOPT -A -STREET PARTICIPANTS; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF
FOUNTAIN HILLS AS FOLLOWS:
Section 1. That the Town Code Chapter 16, Streets and Sidewalks, Article 16-1,
Encroachments, Section 16-1-3, Other Exceptions to Permit Requirements, shall be amended by
adding a new Section 16-1-3.E, to read as follows:
® Section 16-1-3.E No permit or fee is required for properly
permitted participants of the Adopt -A -Street program.
Section 2. That it is the intention of the Town that the enforcement of this ordinance
shall become effective immediately; it is necessary in order to protect the public health, safety
and welfare that an emergency be declared and this ordinance shall become operative
immediately upon the affirmative vote of six of the seven members of the Town Council. That
as an emergency measure, this ordinance is exempt from the provisions of referendum.
