® AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING CHAPTER 7 OF
THE FOUNTAIN HILLS CODE CONCERNING BUILDING AND
BUILDING REGULATIONS, SECTION 7-1-1.A.1. TO REMOVE THE
EXEMPTION OF GROUP R, DIVISION 3 AND GROUP M
OCCUPANCIES FROM THE CERTIFICATE OF OCCUPANCY
REQUIREMENTS OF THE 1991 EDITION OF THE UNIFORM BUILDING
CODE
WHEREAS, The Town of Fountain Hills desires to have all housing to be safe, descent and
sanitary; and
WHEREAS, The Town of Fountain Hills has adopted the 1991 edition and all supplements of
the Uniform Building Code to regulate the construction of houses and accessory
structures built within the Town; and
WHEREAS, Single-family residences and garages (Group R, Division 3 and Group M)
occupancies are exempt from the certificate of occupancy requirements of the
1991 edition of The Uniform Building Code; and
WHEREAS, The Town of Fountain Hills desires to remove of the exclusion to the Group R,
Division 3 and Group M occupancies from Section 308 of the 1991 edition of The
® Uniform Building Code.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. CHAPTER 7 BUILDINGS AND BUILDING REGULATIONS, ARTICLE 7-1
TECHNICAL CODES, Section 7-1-1 Adoption by Reference; Violations,
subsection A.1. of the Fountain Hills Code shall be amended by deleting the
following exception to the 1991 edition to The Uniform Building Code, Section
308, as follows:
Certificate of Occupancy
Sec. 308. (a) Use and Occupancy. No building or
structure shall be used or occupied, and no change in the
existing occupancy classification of a building or structure
or portion thereof shall be made until the building official
has issued a Certificate of Occupancy therefor as provided
herein.

construed as an approval of a violation of the provisions of
this code or of other ordinances of the jurisdiction.
Certificates presuming to give authority to violate or cancel
the provisions of this code of other ordinances of the
jurisdiction shall not be valid.
