AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HELLS, ARIZONA, AMENDING THE TEXT OF
THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS,
ARIZONA PURSUANT TO CHAPTER 2, SECTION 2.01 OF THE ZONING
ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS, AND BY
AMENDING THE OFFICIAL ZONING DISTRICTS MAP OF THE TOWN
OF FOUNTAIN HILLS BY DESIGNATING LOTS 1 THROUGH 4 AND 15
THROUGH 26, PLAT 515 AMENDED FINAL PLAT, FROM "OSR", OPEN
SPACE RECREATIONAL ZONING DISTRICT, "R1-35" AND "Rl-10",
SINGLE FAMILY RESIDENTIAL ZONING DISTRICT TO "B1-10"9
SINGLE FAMILY RESIDENTIAL ZONING DISTRICT, AND; BY
AMENDING THE OFFICIAL ZONING DISTRICTS MAP OF THE TOWN
OF FOUNTAIN HILLS BY DESIGNATING LOTS 11 THROUGH 14, PLAT
515 AMENDED FINAL PLAT, FROM "OSR", OPEN SPACE
RECREATIONAL ZONING DISTRICT AND "R1-35", SINGLE FAMILY

DISTRICTS MAP OF THE TOWN OF FOUNTAIN HILLS BY
DESIGNATING TRACTS "A" AND "B", PLAT 515 AMENDED FINAL
PLAT, FROM "R143", "R1-35" AND "R1-10", SINGLE FAMILY
RESIDENTIAL ZONING DISTRICT TO "OSR", OPEN SPACE
RECREATIONAL.
WHEREAS, The Town of Fountain Hills adopted Ordinance #93-22, on November 18, 1993,
which adopted the Zoning Ordinance for the Town of Fountain Hills; and
WHEREAS, Chapter 2, PROCEDURES. Section 2.01, Amendments or Zone Changes.
establishes the authority and procedures for amending the zoning district

boundaries; and
® WHEREAS, Chapter 3 ESTABLISHMENT OF ZONING DISTRICTS AND
BOUNDARIES THEREOF, Section 3.02 Boundaries Lines on the Zoning
Districts Maps. establishes the "Official Zoning Districts Map"; and
WHEREAS, Public hearings were advertised in the May 10, 1995, May 17, 1995, May 24,
1995, May 31, 1995, June 7, 1995 and June 14 1995, editions of The Times of
Fountain Hills and Rio Verde, pursuant to Arizona Revised Statutes §9462.04,
and
WHEREAS, Public hearings were held by the Fountain Hills Planning and Zoning Commission
on May 25, 1995 and June 8, 1995 and the Mayor and Common Council on June
15, 1995; and
WHEREAS, The Future Land Use Plan in the "Fountain Hills General Plan" designates Lots
1-4 and lots 15-26, Plat 515 Amended, as a Single-Family/Medium and Open
Space and lots 5-14, Plat 515 Amended as Single Family/Very Low; and
WHEREAS, The predominant character of the Plat 515 Amended neighborhood where Lots 1
through 26, Plat 515 Amended, is located, will be single-family residential on lots
in the 10,000 square feet or greater range.
® NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. The "Official Zoning Districts Map" shall be amended to change the Zoning
District designation of Lots 1 through 4 and 15 through 26, Plat 515 Amended
Final Plat, from "OSR", Open Space Recreational Zoning District, "R1-35" and
"R1-10", Single Family Residential Zoning District to "R1-10", Single Family
Residential Zoning District.
Section 2. The "Official Zoning Districts Map" shall be amended to change the Zoning
District designation of lots 11 through 14, Plat 515 Amended Final Plat, from
"OSR", Open Space Recreational Zoning District and "R1-35", Single Family
Residential Zoning District to "R1-18", Single Family Residential Zoning District.
Section 3. The "Official Zoning Districts Map" shall be amended to change the Zoning
District designation of Lots 5 through 10, Plat 515 Amended Final Plat, from "Rl-
43" and "R1-35", Single Family Residential Zoning District to "RI-35H PUD"
Single -Family Residential Zoning District.

® Section 4. The "Official Zoning Districts Map" shall be amended to change the Zoning
District designation of tracts "A" and 'B", Plat 515 Amended Final Plat, from
"R1-43", "R1-35" and "R1-10" Single Family Residential Zoning District to
"OSR", Open Space Recreational Zoning District.

Section 5. The text of the Zoning Ordinance of the Town of Fountain Hills shall be amended
to include the Planned Unit Development for the Final Plat of Plat 515 Amended
to reduce the required lot width from one hundred forty five (145) feet to one
hundred ten (110) feet for lot 10 only which will allow for the continuation of the
natural drainage way on the north side of this lot.
PASSED AND ADOPTED BY the Mayor and Common Council of the Town of Fountain Hills,
Arizona, this 15th day of June, 1995.
