AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ANNEXING CERTAIN
REAL PROPERTY IN SECTION 17, TOWNSHIP 3 NORTH,
RANGE 6 EAST WHICH IS ADJACENT TO THE EXISTING
TOWN LIMITS AND BEING ANNEXED PURSUANT TO
A.R.S. § 9-471.02.
BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN
OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. That A.R.S. § 9-471.02. provides for the de -annexation of land from one
municipality and the annexation to another municipality if all of the conditions of the
Statute are met.
Section 2. That attached hereto, and marked as Exhibit A, is a legal description of
approximately 108 acres of land in Section 17, of Township 3 North, Range 6 East of the
Gila and Salt River Base and Meridian, and the property described in Exhibit A is
contiguous to the Town of Fountain Hills.
® Section 3. That attached hereto, and marked as Exhibit B, is a map depicting the area
legally described in Exhibit A.
Section 4. That the real property described in Exhibit A and depicted in Exhibit B, is
currently within corporate limits of the City of Scottsdale, Arizona, and that it is the
understanding of the Mayor and Council of the Town of Fountain Hills, that the Mayor and
Council of the City of Scottsdale will or has adopted an Ordinance of de -annexation
consistent with the provisions A.R.S. § 9-471.02.
Section 5. That the Mayor and Council of the Town of Fountain Hills hereby expresses
its intention to annex the territory set forth in Exhibits A and B, and does, hereby declare,
the annexation of said territory to have occurred contingent only upon the fulfillment of
all of the conditions of A.R.S. § 9-471.02.
Section 6. That the Town Manager, Town Clerk and Town Attorney, are, hereby,
authorized and directed to forward a certified copy of this Ordinance to the Mayor and
Council and City Clerk of the City of Scottsdale and to the Chairman of the Board and the
Clerk of the Board of Supervisors of Maricopa County, evidencing its successful passage
on the day and date written below.

A portion of Section 17, Township 3 North, Range 6 East of the Gila
and Salt River Base and Meridian, Maricopa County, Arizona more
particularly described as follows:
Commencing at the West Quarter Corner of said Section 17, thence
North 00 degrees 08 minutes 33 seconds West along the westerly line
of said Section a distance of 550.00 feet to the POINT OF
BEGINNING; thence North 32 degrees 58 minutes 07 seconds East a
distance of 1341.31 feet; thence North 71 degrees 54 minutes 40
seconds East a distance of 418.69 feet; thence North 86 degrees 54
minutes 47 seconds East a distance of 362.36 feet to the beginning
of a tangent curve concave southwesterly and having a radius of
500.00 feet; thence easterly along the arc of said curve through a
central angle of 59 degrees 48 minutes 50 seconds an arc length of
521.98 feet; thence South 33 degrees 16 minutes 23 seconds East a
distance of 458.83 feet to the beginning of a tangent curve concave
northeasterly and having a radius of 500.00 feet; thence
southeasterly along the arc of said curve through a central angle
of 29 degrees 12 minutes 45 seconds an arc length of 254.93 feet;
thence South.62 degrees 29 minutes 08 seconds East a distance of
328.61 feet; thence South 03 degrees 10 minutes 34 seconds East a
distance of 382.71 feet; thence South 54 degrees 30 minutes 00
seconds East a distance of 753.41 feet; thence South 60 degrees 00

96.86 feet to the beginning of a tangent curve concave westerly and
having a radius of 20.00 feet; thence southerly along the arc of
said curve through a central angle of 88 degrees 55 minutes 15
seconds an arc length of 31.04 feet to a point of reverse curve on
the proposed westerly right of way line of Palisades Boulevard,
said curve being concave southeasterly and having a radius of
1042.00 feet, a radial line passing through said point bears North
34 degrees 39 minutes 45 seconds West; thence southwesterly along

right of way of Palisades Boulevard, North 52 degrees 10 minutes 38
seconds West a distance of 528.12 feet; thence North 58 degrees 19
