AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN
OF FOUNTAIN HILLS, ARIZONA AMENDING ITS TOWN CODE, CHAPTER
7 BUILDINGS AND BUILDING REGULATIONS BY ADDING A NEW ARTICLE
7-9 REQUIRING AUTOMATIC FIRE EXTINGUISHING SYSTEMS.
WHEREAS, A.R.S. 9-240.B.7.(a) grants to the Council the power within the corporate
limits of the Town to provide regulations for the prevention and extinguishment of fires; and.
WHEREAS, the Town Council finds that the requirement of Automatic Fire Extinguishing
Systems will provide a benefit of great significance for the public safety, health and welfare; and,
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON
COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. That the Town Code, Chapter 7 Buildings and Building Regulations, is
hereby amended with the adoption of a new Article 7-9 Automatic Fire Extinguishing Systems
containing 7-9-1 Requirement; 7-9-2 Effective Date; 7-9-3 Exceptions reading as follows:

7-9-1 Automatic Fire Extinguishing Systems required.
a. An Automatic Fire Extinguishing System is required in all new construction.
b. An Automatic Fire Extinguishing System is required whenever a building permit
is requested for remodeling, reconstruction or expansion of an existing building or structure, the
gross area of the remodeling, reconstruction or expansion is equal to or more than 1/2 of the
existing building or structure.
C. An Automatic Fire Extinguishing System is required whenever an accessory
building or detached building is added to a lot or parcel regardless of the size of the accessory
or detached so long as it is of the type required to be sprinkled under the Uniform Fire Code
together with amendments and appendixes thereto as adopted by the Fountain Hills Fire District.
7-9-2 Effective Date
The requirements of Section 1 above shall apply to all requests for building permits filed
with the Town of Fountain Hills beginning on Monday, January 1, 1996.

7-9-3 Exceptions
® Should the requirements of Sections 1 & 2 above constitute a hardship for any property
owner, that property owner may request, in writing, to the Town Clerk that the issue of an
exception to the requirements of Sections 1 & 2 above be placed on an agenda of the Town
Council for consideration and decision by the Town Council. The property owner shall present,
in writing, to the Town Council at least ten days prior to the Council meeting written material
demonstrating why the hardship exists and why an exception to the requirements of Sections 1
& 2 above should be granted. The Council may exempt any property owner from their
requirements of Sections 1 & 2 above by an affirmative vote of a majority of the Town Council
voting on the matter.
Section 2. That the Ordinance upon passage and adoption by the Mayor and Common
Council of the Town of Fountain Hills shall become effective at 12:01 AM on Monday, January
1, 1996.
