® ORDINANCE #95-30
AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING CHAPTER 6 OF
THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS BY
ESTABLISHING A FIVE FOOT HEIGHT LIMIT FOR FREE-STANDING
SIGNS WITHIN ALL COMMERCIAL AND INDUSTRIAL ZONING
DISTRICTS, PURSUANT TO CHAPTER 2, SECTION 2.01 OF ZONING
ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS.
WHEREAS, The Town of Fountain Hills adopted Ordinance #93-22, on November 18, 1993,
which adopted the Zoning Ordinance for the Town of Fountain Hills, and;
WHEREAS, Chapter 2, Section 2.01 of the Zoning Ordinance for the Town of Fountain Hills,
provides for a procedure to amend said ordinance, and;
WHEREAS, The Town of Fountain Hills desires to establish a five-foot maximum height limit
for freestanding signs within all commercial and industrial zoning districts, and;
® WHEREAS, The procedures detailed in Chapter 2, Section 2.01 of the Zoning Ordinance for
the Town of Fountain Hills have been followed; and
WHEREAS, The Town of Fountain Hills has rewritten the text of Chapter 6 of the Zoning
Ordinance of the Town of Fountain Hills and published these proposed text
changes in the official newspaper of general circulation, The Times of Fountain
Hills and Rio Verde on September 13, 1995, September 20, 1995, September 27,
1995 and October 4, 1995, and;
WHEREAS, Public hearings were advertised in the September 13, 1995, September 20, 1995,
September 27, 1995 and October 4, 1995 editions of The Times of Fountain Hills
and Rio Verde, pursuant to Arizona Revised Statutes §9-462.04, and
WHEREAS, Public hearings were held by the Fountain Hills Planning and Zoning Commission
on September 28, 1995 and by the Fountain Hills Town Council on October 5,
1995.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS:

® Section 1. Pursuant to Chapter 2, Section 2.01 of the Zoning Ordinance for the Town of
Fountain Hills, Chapter 6 of the Zoning Ordinance for the Town of Fountain Hills
shall be amended to establish a five foot height limit for freestanding signs within
all commercial and industrial zoning districts as follows:

6.07 Signs Permitted For Non -Residential Uses In The Following Districts:
B. GO District.
2. Business signs shall be in accordance with the following regulations:
b. Freestanding identification signs shall be counted as a portion of
the total aggregate sign area of the premises and shall be restricted
® to the following:
(1) One (1) freestanding identification for each street upon
which the lot has frontage.
(2) Such signs shall have a maximum area of twenty-four (24)
square feet.

(34) Such signs shall not be closer than thirty (30) feet to any
residential district.
(45) A landscaped area shall be provided, on site at the street
frontage at the base of the freestanding sign, with said
landscaped area to have a minimum area of four (4) square
feet for each square foot of sign area.

PASSED AND ADOPTED BY the Mayor and Common Council of the Town of Fountain Hills,
Arizona, this 5th day of October, 1995.
