ORDINANCE #95-33
AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA, AMENDING THE OFFICIAL ZONING DISTRICT MAPS
OF THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS BY
REALIGNING THE WITH THE SUNRIDGE CANYON PARCEL 'O' SUBDIVISION TO
DESIGNATE 5.408 ACRES OF LAND FROM *RI-8A' TO 'OPEN SPACE
RECREATIONAL' ('OSR'); AND 4.762 ACRES OF LAND FROM 'OSR' TO'RI -8A',
IN ACCORDANCE WITH CHAPTER 3, SECTION 3.02 OF THE ZONING
ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS.
WHEREAS The Town of Fountain Hills adopted Ordinance #93-22, on November 18,
1993, which adopted the Zoning Ordinance for the Town of Fountain Hills,
and
WHEREAS Chapter 2, Section 2.01 of the Zoning Ordinance for the Town of Fountain
Hills, provides for a procedure to amend said ordinance, and
WHEREAS The Town of Fountain Hills desires to amend its Official Zoning Districts Map;
and
Is for
The procedures detailed in Chapter 2, Section 2.01 of the Zoning Ordinance
for the Town of Fountain Hills have been followed; and
WHEREAS The Town of Fountain Hills has published In this proposed Official Zoning
Districts Map amendment in the official newspaper of general circulation,
The Times of fountain Hills and Rio Verde on March 8, 15, 22, and Juy 19,
26, and August 2, 1995, and
WHEREAS The Planning and Zoning Commission held a public hearing on March 23,
1995 and advertised this public hearing in the March 8, 15, and 22, 1995
editions of The Times of Fountain Hills and Rio Verde, pursuant to Arizona
Revised Statutes §9-462.04 and
WHEREAS The Town Council held a public hearing on August 3, 1995 and advertised
this public hearing in the July 19, 26, and August 2, 1995 editions of The
Times of Fountain Hills and Rio Verde, pursuant to Arizona Revised Statutes
§9-462.04.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN
OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. The 5.408 acre areas (Area 1 (0.9931 acres), Area 3 (0.0934 acres), Area 5
(.3035 acres), Area 7 (.0123 acres), Area 9 (2.6295 acres), and Area 13
(1.3764 acres)) described in Attachment 'A' and shown in Attachment 'B',
® shall be designated as Open Space Recreational 'OSR' on the Official
Zoning Districts Map of the Zoning Ordinance forwn of Fountain Hills.

® Section 2. The 4.734 acre area described in Attachment 'A'and shown in Attachment
'B' shall be designated as 'RI-8A' on the Official Zoning Districts Map of the
