AN ORDINANCE OF THE MAYOR AND COMINION COUNCIL OF THE
TOWN OF FOUNTAIN HILLS, ARIZONA, ANTENDING THE ZONING
ORDINANCE FOR THE TOWA' OF FOUNTAIN HILLS PURSUANT
CHAPTER 2, SECTION 2.01, BY AMENDING CHAPTER 6, SIGN
REGULATIONS, SECTION 6.03 GENERAL REGULATIONS TO CLARIFY
THAT TEMPORARY OFF -PREMISE SIGNS ARE PROHIBITED IN
CENTER MEDIANS OF ROADWAYS; AND SECTION 6.12 SIGN
PERTMITS, FEES, TO EYENIPT TEINIPORARY OFF -PREMISE SIGNS
FROM THE PERMITTING AND FEE REQUIREINIENTS FOR SIGNS.
WHEREAS Chapter 2. PROCEDURES. Section 2.01. Amendments or Zone Changes.
establishes the authority and procedures for amending the zoning ordinance: and
WHEREAS The Town of Fountain Hills advertised public notices of a size that were one -
eighth page or greater in size, in the official newspaper of general circulation. the
Times of Fountain Hills, on November 29, December 6. 13, and 20. 1995 of
public hearings held by the Fountain Hills Planning and Zoning Commission on
December 14, 1995 and by the Fountain Hills Town Council on December 21,
1995, to invite comments from the public: and
® WHEREAS CHAPTER 6 SIGN REGULATIONS has conflicting regulations in Sections 6.03
General Regulations and Section 6.08 TemporaryV Signs. concerning the
permission of placing signs in center medians: and y
WHEREAS The Town desires to have consistent language in its regulations: and
WHEREAS CHAPTER 6 SIGN REGULATIONS Sections 6.12 Sign Permits, Fees. requires
that a permit be secured and a fee charged for a sign to be erected: and
WHEREAS The Town does not desire to require sign permits nor fees to erect temporary off -
premise signs:
NOW THEREFORE BE IT ORDAINED BY THE NIAYOR AND COMb10N COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. CHAPTER 6, SIGN REGULATIONS, Section 6.03 General Regulations,
Subsection G. of the Zoning Ordinance for- the Town of Fountain Hills shall be
amended to prohibit signs in the center median. The areas shaded are the
additions to the text.

® 6.03 General Regulations.
G. No sign shall be erected or placed within any centert,af e median
or any public sidewalk or bicycle path. The Town employees may
remove any sign located in these areas. Directional signs owned
by the Town of Fountain Hills shall be exempted from these
regulations.
Section 2. CHAPTER 6, SIGN REGULATIONS, Section 6.12 Sign Permits; Fees of the
Zoning Ordinance for the Town of Fountain Hills shall be amended to exempt the
permit and fee requirements for temporary off -premise signs. The area shaded are
the additions to the text.
CHAPTER
SIGN REGULATIONS
6.12 Sign Permits; Fees.
A. It shall be unlawful to erect. install and/or modify any sign within
the Town without first applying for and obtaining a Sign Permit
® from the Department of Community Development. "Modify." as
it is used herein, shall mean any change in or to an existing sign,
its face, electrical components. design and/or supporting structures.
Temporary off -premise signs authorized in Section 6._08.E. of this
Chapter are exempt from the sign permit and fee requirements of
this section:
