HomeMy WebLinkAboutOrd 1995-54® ORDINANCE 95-54 AN ORDINANCE OF THE MAYOR AND COINIMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, ANIENDING THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS PURSUANT CHAPTER 2, SECTION 2.01, BY AMENDING CHAPTER 1 INTRODUCTION, CHAPTER 9 OPEN SPACE RECREATIONAL ZONING DISTRICT (OSR), CHAPTER 10 SINGLE-FADIILY RESIDENTIAL ZONING DISTRICTS: R-190, R143, R1-35, RI-35H, R1-18, R1-10, R1-10A, RI-8, RI-8A, RI-6, RI-6A, and CHAPTER 11 MULTI -FAMILY RESIDENTIAL ZONING DISTRICTS, M-1, M-2, M-3, R-2, R-3, R-4, AND R=S; TO PERMIT SALES AND INFORMATION CENTERS FOR MASTER DEVELOPERS IN MASTER -PLANNED VILLAGES BY TEMPORARY USE PERMIT ONLY. WHEREAS Chapter 2. PROCEDURES. Section 2.01, Amendments or Zone Changes. establishes the authority and procedures for amending the zoning ordinance: and WHEREAS The Town of Fountain Hills has master -planned villages developing in within its borders; and y WHEREAS The Town desires to define the terms "Master -Planned Village" and "Master - Planned Village Sales and Information Center" in CHAPTER 1 INTRODUCTION, Section 1.12 Definitions: and WHEREAS The Town desires to provide for the developers of master -planned villages the opportunity to have sales and information centers in non -commercially zoned areas by temporary use permit: and WHEREAS The Town of Fountain Hills has drafted amendments to the Zoning Ordinance for the Town of Fountain Hills to permit sales/information centers by temporary use permit only in CHAPTER 9 OPEN SPACE RECREATIONAL ZONING DISTRICT (OSR), CHAPTER 10 SINGLE-FAMILY RESIDENTIAL ZONING DISTRICTS: R-190, R143, R1-35, R1-35H, R1-18, R1-10, 111-10A, RI-8, RI-8A, RI-6, RI-6A, and CHAPTER 11 MULTI -FAMILY RESIDENTIAL ZONING DISTRICTS, M-1, M-2, M-3, R-2, R-3, R-4, AND R-5: and WHEREAS The Town of Fountain Hills has advertised these proposed amendments and of public hearings held by the Fountain Hills Planning and Zoning Commission on December 14, 1995 and by the Fountain Hills Town Council on December 21. 1995, to invite comments from the public, in public notices of a size that were greater than one -eighth page, in the official newspaper of general circulation. the Times of Fountain Hills, on November 29, December 6. 13, and 20. 1995 ; and ® Ordinance #95-54 Page I of 7 FOFAIL MOTIONrcn SECOND W, COUNT O' }i C.r�_ ® NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS: Section 1. CHAPTER 1 INTRODUCTION, Section 1.12 Definitions if the Zoning Ordinance for the Town of Fountain Hills shall be amended to add the terms "Master -Planned Village" and "Master -Planned Village Sales and Information Center". The areas shaded are the additions to the text. CHAPTERI 1.12 Definitions. For the purpose of this ordinance, certain words and terms used herein are defined as follows: All words used in the present tense include the future tense: all words in the plural number include the singular number, all words in the singular number include the plural number, unless the natural construction of the wording indicates otherwise. Gender shall be universal. any reference to one gender shall also implicitly refer to the other gender. The word "shall" is mandatory and not discretionary. Other words and phrases used in the ordinance shall have ® the following meanings: Nl ster-Planned Village._ A development containing over 320 contiguous 'acres contained in a_master subdivision plat by a single developer. Ma_sF _-Planned Village Sales and Infocmation Center. A facility that is used as an information/sales facility by the master developer in a ter mas-planned village — — -- Section 2. CHAPTER 9 OPEN SPACE RECREATIONAL ZONING DISTRICT (OSR CHAPTER 10 SINGLE-FAMILY RESIDENTIAL ZONING DISTRICTS: R- 190, R1-43, R1-35, 111-35H, R1-18, R1-10, RI-10A, RI-8, RI-8A, RI-6. RI-6A, and CHAPTER 11 MULTI -FAMILY RESIDENTIAL ZONING DISTRICTS, M-1, M-2, M-3, R-2, R-3, R-4, AND R-5: of the Zoning Ordinance for the Town of Fountain Hills shall be amended to add language to permit Master -Planned Village Sales and Information Centers in Master Planned Villages in these zoning districts by temporary use permit only. The areas shaded are the additions to the text. 0 Ordinance #95-54 Page 2 of 7 ® CHAPTER OPEN SPACE RECREATIONAL ZONING DISTRICT (OSR) 9.03 Uses Subject to Temporary Use Permit: lage D�Iaster-Planned VilSales and InnformatioCenter_ Within _a Clubhouse. The developer of a master -planned village may operate an information/sales facility within a clubhouse by temporary use permit only, as specified_in CHAPTER 2 PROCEDURES. Section 2.03 Temporary? Use Permits. At a minimum_ the following standards shall appl- On-site sales personnel must be present at least five_(5)_days a week_ during normal business hours. In no case shall a center be open before 7:00 A.M.-or after 9. - P.M? 2, The center shall be for the purpose of marke[inL the specific master -planned village and_ the distribution of material concerning the attributes of the Town and surroun_ding_areas;The office may not be used as an office for the sales of houses subdivisions with model homes, nor property OLit de o the master-pplanned village: ® 3: There shall be at least twenty (20) off-street parking stalls provided in addition to the minimum parking demand for the golf course. 4: The use shall cease upon termination_ of the temporary use permit or the completion of t_he mas_te_r_d_evelope_r_'s_ marketin_g_activitie_s., whichever comes first) 5� Signage shall be in conformance_ with Chapter 6. The center shall be removed_ upon termination of the temporary_ use .permit or the completion of the master developer's marketing activities, whichever comes first: 7 Signage shall be in conformance with Chapter 6 Section 6.07 of this ordinance: is Ordinance #95-54 Page 4 of 7 8. There shall be -a landscape buffer of at least 150 feet between the sales and information_ center and any occupied residential strurttires} a. Landscaped areas shall include art approved mixture of drought tolerant or other plant materials, and organic and non -organic ground cover materials! Landscaping shall consist of one plant for .each _20 square feet of landscape area. At least rkventy_fi%e (25) percent of the plants shall be 15 gallon or greater plants and the remaining plants m_nst be of least five gallon plants _The approval of the' above mixture of landscape materials shall be_by the Community Development_ Department staff witli appeal to the Planning and Zoning Commission: b. An automatic irrigation _system_ shall_ be provided and maintained to all landscaped areas _requiri g water. All landscaped areas adjacent to vehicular parking and access areas shall be protected by six (6) inch vertical concrete curbing in order to control storm water Flows and minimize damaue by vehicular, traffic. CHAPTERII NIULTI-FAMILY RESIDENTIAL ZONING DISTRICTS, R-2, R-3, R-4 and R-5. 11.04. Uses Subject to Temporary Use Permit: D. Master -Planned Village Sales and Information Center. _The developer of a master -planned village may operate an information/sales facility within a residentially zoned area by temporary use permit onlyas specified in CHAPTER 2 PROCEDURES. Section _ 2.03 Temporary Use Permits. At a minimum, the following standards shall apply.' On -site sales personnel must be present at least five (5) days a week during normal business_ hours.
