HomeMy WebLinkAbout1990.0123.TCWSM.MinutesMINUTES OF SPECIAL SESSION TOWN COUNCIL THE TOWN OF FOUNTAIN HILLS 1 January 23, 1990 The Town Council of the Town of Fountain Hills met in special session on Tuesday, January 23, 1990, at 6:30 p.m., at the Fountain Hills School District Administration Building, Fountain Hills, Arizona. ROLL CALL The meeting was called to order at 6:30 p.m., followed by the pledge to the flag. Roll call was taken and the following council members were present: Harry Barber, Marti Lemieux, Joe Bill, John Cutillo, Charlie Fox and Dick Haugen. Mike Minarsich came in shortly following roll call. MINUTES Dick Haugen made a motion to accept the minutes from the January 18, 1990 meeting as read and Marti Lemieux seconded. Motion passed unanimously. OLD BUSINESS Agenda Item #3: John Cutillo readdressed the need to get a telephone number for the town. The deadline for the telephone book is February 9, 1990, which is earlier than thought when the item was tabled. A number will be ordered but will exist only in the central office. Remote call forwarding will be placed on the new number, which, until it is installed, will be forwarded to the Town Clerk's number. The number will still not be guaranteed until it is physically installed. Dick Haugen made a motion to acquire a telephone number as described above so that the number can get in the new telephone book. Marti Lemieux seconded the motion. Ken Sparks asked how the number would be paid for. Dick Haugen amended the motion to include that the number would not be installed until February 1, 1990. Marti Lemieux again seconded. NEW BUSINESS Agenda Item #4: John Cutillo clarified the agenda item as stated, explaining that the council hoped to appoint an interim town manager to act on a voluntary basis until February 1, 1990. Following the acceptance of the interim town budget, the town manager would be hired at a monthly salary of $4,333.33 on a monthly contract basis. Harry Barber moved to nominate Mike McNulty as interim town manager. Marti Lemieux seconded. The motion passed unanimously. Agenda Item #5: John Cutillo recounted that candidates were interviewed on January 18, 1990. Marti Lemieux made a motion that the council retain William Farrell of the law firm Ryley, Carlock & Applewhite to act as town attorney and Dick Haugen seconded the motion. Following a question by Ken Sparks, John Cutillo clarified that the attorney would be retained after the budget was adopted. Marti Lemieux amended the motion to read that the council would retain William Farrell of the law firm Ryley, Carlock & Applewhite as legal council after February 1, 1990. Dick Haugen again seconded the motion. 2 Joe Bill asked that the record show that he would not be voting. The remainder of the council voted unanimously to pass the motion. The public asked if the new town attorney lived in Fountain Hills and was told that he lived in Scottsdale and practiced in Phoenix. Agenda Item #6: John Cutillo recommended in the interest of expediency that the law firm of Dick Erickson continue to work on this one item. Dick Haugen asked if this was until February first and John responded that it should be for however long it takes. Charlie Fox made a motion that the attorney Dick Erickson continue and complete the action that he had already started for the council. Dick Haugen seconded. Danny Tancredi again asked about payment and John responded that there has been no agreement or promise to pay at this point. John also briefly answered a question by describing the legal questions involved in this matter. The motion passed unanimously. Agenda Item #7: Charlie Fox moved that the mayor contact the joint powers chairman and set up an executive session between the road district trustees and the town council and that it take place within the next 10 days or sooner. Mike Minarsich asked if legal services would need to be present. Charlie Fox said since the session involved a lawsuit, council would need to be present. Charlie amended the motion to state that the meeting be held within the first five days of February. Mike brought up duplication of legal fees and which attorney should be used. John Cutillo preferred to go with new council since the case may go on for some time. Mike Minarsich seconded the amended motion. Charlie Fox restated the motion, moving that the mayor contact the joint powers chairman and set up an executive session between the two boards to discuss the possible partnership in the lawsuit settlement to take place within the first five days in the month of February. Harry Barber seconded. Agenda Item #8: During the call to the public, a question arose as to the attorney's fees. John Cutillo said the hourly rate is $100.00 per hour. He also told Dennis Regeski that no retainer was being paid. Mike Minarsich gave alittle of Bill Farrell's background and experience. ADJOURNMENT Prior to adjournment, John Cutillo explained how the work session would be conducted and welcomed the public to attend. He did explain that it was customary in work sessions that the public could observe but not participate. The meeting was adjourned at 6:50 p.m. MINUTES OF WORK SESSION TOWN COUNCIL THE TOWN OF FOUNTAIN HILLS January 23, 1990 The Town Council of the Town of Fountain Hills met in a work/study session following the special meeting on Tuesday, January 23, 1990, at the Fountain Hills School District Administration Building, Fountain Hills, Arizona. Following a ten minute break, the session, began at approximately 7:00 p.m. Wallace Hudson began the session by giving a brief report on the insurance status of the town. He said that effective midnight, January 23, 1990, the town would have workman's compensation insurance as required by law. RE: bonding and liability insurance that we're required to have, research has been done into the companies that write this kind of insurance. He said they would have proposals from these companies by 9:00 a.m. tomorrow. These companies will be giving presentations to the insurance subcommittee at 3:00 p.m. on January 31, who will then make a recommendation to the board. The council then began listing subcommittees that need to be formed to set up a running, functioning town. During this time they identified some of the things they want to accomplish during the interim six month time period such as establishing boards, having the county get the roads they're responsible for up to par, finalizing a budget, getting town codes in place, adopting county ordinances and modifying where needed, getting the necessary staff in place, establishing liasons with other community entities ie. schools, Chamber, etc. as well as other governmental entities ie. legislature, county, Indian reservation, etc. Joe Bill suggested a top down planning approach. As the council formulated a list of subcommittees to handle different areas and fulfill various needs of the community, a multitude of considerations were identified. After creating a list of 21 areas to be considered, subcommittees were modified, clarified, consolidated and prioritized. The final list formulated by the council appears on the attached sheet. It was decided that a meeting would be called for Thursday night to publicly announce the committees and appoint councilmembers to sit on the committees.
