HomeMy WebLinkAbout1990.0517.TCRM.MinutesTOWN OF FOUNTAIN HILLS MINUTES OF THE REGULAR MEETING OF THE FOUNTAIN HILLS TOWN COUNCIL MAY 17, 1990 A public meeting of the Fountain Hills Town Council was convened and called to order by Mayor John Cutillo at 6:31 p.m., Thursday, May 17, 1990, in the Fountain Hills School District Administration Building located at 14605 N. Del Cambre Ave., Fountain Hills, Arizona. ROLL CALL - Present for roll call were the following members of the Fountain Hills Town Council: Mayor John Cutillo, Vice Mayor Mike Minarsich and Councilmembers Marti Lemieux, Joe Bill, Charlie Fox and Peg Tibbetts. Councilman Bill O'Brien came in at approximately 6:33 p.m. Also present were Town Na nager Mike McNulty, Town Attorney Bill Farrell and Town Clerk Cassie Hansen. Mayor Cutillo asked that the record show that Councilmembers Elect Clark and Hudson were in attendance. AGENDA ITEM #2 - ACCEPTANCE OF APRIL 19 & MAY 1ST MEETING MINUTES Councilman Fox made a MOTION to accept the minutes of April .19th and May 1st, 1990. SECONDED by Councilwoman Tibbetts and CARRIED unanimously. AGENDA ITEM #3 - PRESENTATION OF CERTIFICATES OF RECOGNITION Mayor Cutillo presented certificates of recognition to Mary Wood of the Town Magistrate Subcommittee, Walls- Hudson and Bill Grigsby- of the Insurance Subcommittee, Lari Bratcher, Jerry Jones, Ray Baldwin, Loras Rauch and Jim Bonanno of the Planning and Zoning Subcommittee, Peg Tibbetts, Norman Lash and Wally Hudson of the Personnel Subcommittee. AGENDA ITEM #4 - ACTION ON THE LIQUOR_LICENSE_APPLICATION _FOR FOUNTAIN BOWL Councilman Fox made a MOTION to approve the .liquor license for the Fountain Bowl. SECONDED by Councilwoman Lemieux and CARRIED unanimously. AGENDA ITEM #5 - ACTION ON JOINING THE MARICOPA COUNTY LIBRARY ASSOCIATION Bill Farrell said the opportunity- to participate with the Maricopa Cot.inty Library District is a function of some legislation that was passel several years ago which created the county library district. He said municipalities had the option of running their library districts on their own or joining the county district and receiving funds for this purpose. He said it was the staff recommendation to join the County Library District, that the intergovernmental agreement had been prepared and the required public advertising; had been fulfilled. He further said this was an annual requirement. Mavor Cutillo made a MOTION to enter into an intergovernmental agreement between Fountain Hills and the Maricopa County Free Library District. SECONDED by Councilwoman Tibbetts and CARRIED unanimously. AGENDA ITEM #6 - AUTHORIZING THE TOWN MANAGER TO APPLY THE USE OF THE LOGO Minutes of the Town Council Page 1 of 3 Mayor Cutillo made a MOTION authorizing the town manager to apply use c;f the Jc,,gc and obtain the town seal. SECONDED by Vice :Mayor 141inarsich. Councilman Bi11 asked for clarification on what this meant and �lr. ti9cNulty said the town needed to move on with this particular project and that there has been jockeying ba b: and forth as to how the town would handle getting these things done. He said they were looking for direction from the council. Councilwoman Tibbetts asked ;chat the options were and Mr. McNulty said that instead of having staff take care of the development of the logo, the council could hire a professional, a graphic artist to design and secure letterhead, etc. The motion CARRIED unanimously. AGENDA ITEM #7 - AUTHORIZING THE MAGISTRATE TO ORDER A JUDICIAL BENCH AND RAILING Town Magistrate Shoob told the council that to turn the council meeting room into a court would require obtaining a judicial bench and a railing. He said he had tried to reach 4 individuals locally to make a bench to statute specs because attempts at locating "used" judicial benches had failed. He said the railing was necessary for security and traffic flow. He was only able to reach 2 of the 4 people and had gotten quotes of $1,429 and $1,499 plus tax. He said the railing would come to about $100 to $200. Councilman Fox said he knew of 2 other cabinet makers who would like to bid on making the bench and Mr. Shoob asked for the names as soon as possible because he was under tight time contraints because it would take at least 30 days to get the bench made. Councilman O'Brien made a MOTION to authorize the Town ?Magistrate to expend $1,600 to get the work accomplished. SECONDED by Councilman Bill and CARRIED unanimously. AGENDA ITEM #8 - AUTHORIZING THE TOWN ATTORNEY TO MEET WITH DIMENSION CABLE Bill Farrell explained that this ;tias a follo% up to the executive session of last: Thursday evening regarding aspects of the legal relationship with Dimension Cable and this was a ratification of direction that was given in that. meeting. MOTION made by :Mayor Cutillo to authorize the Town Attorney to meet with representatives of Dimension Cable, SECONDED by Councilman O'Brien and CARRIED unanimously. AGENDA ITEM # 9 - AUTHORIZATION TO EXPEND FUNDS ON AERIALMAPS AND PARALEGAL SERVICES _ Mr. Farrell explained the process that was taking place in order to prepare the deeds transferring the roads to the town. He said there are often gaps between the plat maps and the best way to catch these is using aerial maps. He also said it would be a more efficient use of funds and time to hire a paralegal to research the gaps, find out who holds the deeds and that he would be willing to accept an outside cap of not to exceed $1,500 without additional council permission. If there is a question of ownership, the town could approach the oi,ner of record and ask for a dedication. If the person is unwilling the town .ould exercise the power of eminent domain or could file a plat title action or any other number of ways to obtain the title, the power of condemnation being the last but final resort. A landowner may not be aware that the road out in front of his house is not a public road and it was his understanding that the inherent feeling of the council was to have the legal transition of the title to the roads be as complete as possible. He said the paralegal would be researching assessors records to determine ownership and then taking the assessors records to the Minutes of the Town Council Page 2 of 3 recorder to purchase copies of deeds. Vice Mayor rinarsich made a MOTION authorizing the Town Manager to expend funds on 2 aerial maps of Fountain Hills, 1 mounted and suitable for framing and also to expend the funds for the services of a paralegal at the meetings determining the roads to be transferred with a cap at this point in time of not more $1,500 to be spent on that service. SECONDED by Councilman Bill and CARRIED unanimously. AGENDA ITEM #10 - CALL TO THE PUBLIC No one came forward during the call to the public. AGENDA ITEM #11 - ADJOURNMENT Councilman Fox made a MOTION to adjourn, SECONDED by Councilman Bill and CARRIED unanimously.
