MINUTES OF THE WORK/STUDY SESSION OF THE FOUNTAIN HILLS TOWN COUNCIL
SEPTEMBER 17, 1991
A public work study session of the Fountain Hills Town Council was convened and
called to order by Vice Mayor Frank Clark at 6:30 p.m. , Tuesday, September 17,
1991, in the Council Chambers of the Town Hall Offices located at 16836 E.
Palisades Blvd. , Building C, Fountain Hills, Arizona.
Present for roll call were the following members of the Fountain Hills Town
Council : Vice Mayor Frank Clark and Councilmembers Mike Minarsich, Charlie Fox,
Wally Hudson and Bill O'Brien. Mayor John Cutillo and Councilwoman Peg Tibbetts
were absent. Also present were Town Manager Paul Nordin, Town Attorneys Bill
Farrell and Nick Dotterman, Town Planner Gary Jeppson, and Town Clerk Cassie
Hansen.
AGENDA ITEM #2 — TOWN MANAGER'S REPORT
#2.A.1. Beeline Highway update. Mr. Nordin stated that the Arizona Department
of Transportation had entered into contract with Hendrick & Eberhardt, Assoc. ,
for the first phase design work on Beeline Highway from Shea Boulevard to
McDowell. Mr. Nordin said that by the Council meeting on Thursday, all the
signatures would have been obtained. Councilman Minarsich asked what work they
were currently doing and Mr. Nordin said it was some shoulder work and not part
of expansion project. Vice Mayor Clark said that he had spoken to Roger Herzogg
from A.D.O.T. who had given him a copy of their new five year plan. Councilman
Fox asked Mr. Randy Harrel if he had received a response to his letter regarding
a section of the Beeline Highway north of Shea that was being bid by A.D.O.T.
Mr. Harrell 's letter to A.D.O.T. concerned their treatment of Shea Boulevard and
in it he had stated his concerns that they had not allowed for the volume of
traffic SHea Boulevard would carry as a main arterial roadway. Councilman Fox
asked what the bid date for that reconstruction was and Mr. Harrel stated that
he thought it would be some time in November.
#2.B.1. MCO special event request for charity benefit concert in the park. Ms.
Hansen stated that a letter from Marshal Dean to the adjoining jurisdictions had
been added to the special event request packet. She said that it was a response
to the concerns expressed by the Fire District. Councilman Minarsich asked if
the indemnity questions had been addressed satisfactorily. Ms. Hansen said that
the Town had received a letter from MCO, just as was received for the last event
of this type. Mr. Farrell stated that there should be no insurance problem as
it had been presented. Councilman O'Brien voiced a concern about the noise that
the event would produce and Mr. Nordin stated that there was not anything that
could be done about it at this point.
#2.B.2. Approval of engineering contract for P&D Technologies. Mr. Nordin stated
that the contract was similar to the contract for the previously approved
engineering work. He stated that the contract amount was $143,000 and was for
the east project.

#2.B.3. Discuss Chapter 12 of the Town Code. "Traffic", concerning the
requirement for Council approval of all traffic control devices, s.i.gns, signals,
striping, markers and parking restrictions. Mr. Nordin stated that he would like
Council direction on this item. Mr. Nordin asked if Council wanted to have a
number of traffic related items come before them on a routine basis or delegate
some of the authorities to staff. Mr. Dotterman stated that the town code
required Council approval on every signage decision and the legal research that
his office had done indicated that most of these decisions could be delegated to
staff through an Ordinance. Mr. Dotterman said that some of them would have to
be reviewed by the Council because of the way the state statute was worded. He
added that two of them were concerning speed limits and angle parking.
Councilman O'Brien asked about a traffic flow study that was to be presented as
part of the five year plan. Mr. Nordin stated that the item was already being
addressed by Mr. Jeppson and had been funded by the C.G.B.D, Grant. He added
that it was not to be included in the five year plan. Vice Mayor Clark suggested
that the Town follow in line with what the majority of other valley cities did
about delegating to staff the things that they could do. Vice Mayor Clark said
that certain controversial items should continue to be brought before the
Council. Councilman Fox commented that if staff members were the experts, they
should be able to make all the decisions. Vice Mayor Clark agreed and stated
that nothing would be presented to the Council until it had been thoroughly
studied by staff. Mr. Nordin stated that for signalization, the matter would
have to come before the Council for funding. Councilman Hudson agreed that staff
should do everything they legally could. Mr. Harrel answered Councilman
Minarsich's question regarding guide signs, stating that they were any
informational sign. Councilman Minarsich said that he remembered discussions on
the grant and that the money was for replacing approximately two thirds of the
existing street signs in the community. Councilman Fox stated that the grant was
for any type of signage. Mr. Nordin stated that all of the signage talked about
had been ordered and would be installed. Councilman Fox said that there was an
additional $6,000 left for signs. Councilman Minarsich said he wanted to see a
plan before anything new was put in place. Vice Mayor Clark said that he would
like to see the standard welcome to Fountain Hills signs put up at the town
entrances. Mr. Nordin stated that staff would prepare an appropriate ordinance
for a future meeting.
AGENDA ITEM #3 - ORDINANCE 91-17. AMENDING THE TOWN CODE OF THE TOWN OF FOUNTAIN
HILLS, CHAPTER 7 BUILDING AND BUILDING REGULATIONS. ARTICLE 7-1 OF THE TECHNICAL
CODES. SECTION 7-1.-1A. . 5, TO ADOPT THE UNIFORM FIRE CODE AND UNIFORM FIRE CODE
STANDARDS, 1988 EDITION AND THE UNIFORM FIRE CODE SUPPLEMENT. 1989 EDITION AND
THE NFPA FIRE CODES LATEST EDITIONS; AND PRESCRIBING REGULATIONS GOVERNING
CONDITIONS HAZARDOUS TO LIFE AND PROPERTY FROM FIRE OR EXPLOSIONS, AND PROVIDING
FOR THE ISSUANCE OF PERMITS FOR HAZARDOUS USES OR OPERATIONS
Councilman Hudson stated that this had been voted upon per the minutes of June
18, 1990, the same night that the code was adopted. Captain Tom Knapp with Rural
Metro clarified that, by means of the ordinance that was passed, the Town had
adopted the 1988 Fire Code without the standards and without the reference
material from the National Fire Codes. He continued that since the Town was
legally covered by the 1988 Fire Code and in compliance with the State of

The Town Council adjourned the Work/Study session at approximately 7:25 p.m.
