HomeMy WebLinkAbout1992.0714.TCSM.Minutes TOWN OF FOUNTAIN HILLS MINUTES OF THE SPECIAL SESSION OF THE FOUNTAIN HILLS TOWN COUNCIL JULY 14, 1992 A Special Session, open to the public, and possible Executive Session of the Fountain Hills Town Council was convened and called to order by Mayor Cudllo at 6:30 p.m.,Tuesday,July 14, 1992,in the Fountain Hills Council Chambers located at 16836 E. Palisades Blvd., Building C,Fountain Hills, Arizona. ROLL CALL-Following the pledge to the flag and the invocation by Councilwoman Tibbetts,roll call was taken. Present for roll call were the following members of the Fountain Hills Town Council: Mayor John Cutillo, Vice Mayor Charlie Fox, and Councilmembers Peg Tibbetts, Mike Minarsich, Bill O'Brien, and Wally Hudson. Councilman Clark was absent. Also present were Town Manager Paul Nordin,Town Attorney Bill Farrell,Director of Community Development Gary Jeppson, and Town Clerk Cassie Hansen. Mayor Cutillo stated that discussion had been requested on all items listed with an asterisk(*). There would be no separate discussion on unmarked items unless a Councilmember or member of the public so requested, in which event the item would be reconsidered as a discussion item and addressed in its normal sequence on the agenda. AGENDA ITEM#2-CONSIDERATION OF RESOLUTION 1992-18,ABANDONING WHATEVER RIGHT: TITLE, OR INTEREST THE TOWN HAS IN THOSE CERTAIN PUBLIC UTILITY EASEMENTS AND DRAINAGE EASEMENTS AFFECTING ALONG THE REAR LOT LINE OF LOT 14,BLOCK 2,OF PLAN 602A FOUNTAIN HILLS,ARIZONA,AS RECORDED IN BOOK 161 OF MAPS,PAGE 17,RECORDS OF MARICOPA COUNTY, ARIZONA. ,,. AGENDA ITEM#3-CONSIDERATION OF RESOLUTION 1992-19,ABANDONING WHATEVER RIGHT, TITLE, OR INTEREST THE TOWN HAS IN THOSE CERTAIN PUBLIC UTILITY EASEMENTS AND DRAINAGE EASEMENTS AFFECTING ALONG THE NORTH LOT LINE OF LOT 13, BLOCK 2, OF PLAT 212 FOUNTAIN HILLS,ARIZONA,AS RECORDED IN BOOK 141 OF MAPS,PAGE 17,RECORDS OF MARICOPA COUNTY, ARIZONA. AGENDA ITEM#4-CONSIDERATION OF THE SPECIAL EVENT REQUEST FROM THE FOUNTAIN HILLS FIRE DEPARTMENT FOR AN OPEN HOUSE ON SUNDAY,JULY 19,1992 FROM 10:00 A.M.TO 2:00 P.M. NO ROAD CLOSURES ARE INVOLVED. This item was part of the consent agenda. There was no discussion on it. AGENDA ITEM#5- CONSIDERATION OF RESOLUTION 1992-20, APPROVING THE APPLICATION FOR ARIZONA STATE PARKS BOARD HERITAGE FUNDS OR LAND AND WATER CONSERVATION FUNDS FOR GOLDEN EAGLE PARK. Mayor Cutillo stated that the item was on the agenda for discussion only. He said there would be action taken at Minutes of the Town Council Special Session - 07/14/92 Page 1 of 3 the Regular Thursday session. Councilwoman Tibbetts asked how the current application differed from the original one. Mr. Farrell stated that it appeared to be the proforma application. AGENDA ITEM#6-PRESENTATION ON THE REVISED ZONING ORDINANCE PROPOSED BY THE PLANNING AND ZONING COMMISSION FOR COUNCIL STUDY AND CONSIDERATION. Mayor Cutillo thanked the Planning and Zoning Commission for all of their work in preparing the Ordinance. Mr. Jeppson explained what a zoning ordinance was and how it worked in a community. He said that the Town's current zoning ordinance was a carry-over from when Maricopa County presided. Mr.Jeppson stated the Commission had worked hard to make the Ordinance"user friendly." He said the proposed Ordinance had fifteen chapters,compared to the existing one had thirty-nine. Mr. Jeppson stated that the request to amend the Zoning Ordinance would go before the Town Council. He explained the proposed zoning districts. Mr.Jeppson stated that one of the proposed zoning districts was a senior citizen area. He said there was not an area currently zoned for shopping centers. Mr. Jeppson stated that the existing shopping centers were located in C-2 zoning districts. He said that a non-conforming use was a use that lawfully existed at the time of the adoption of the ordinance,but no longer conformed with a new regulation. Mr.Jeppson stated that the proposed Ordinance provided more precise direction in the treatment of non- conforming properties in Fountain Hills. He said that if three inspectors determined that over fifty-percent of the property had been destroyed, the non-conforming use permit would be void. Mr. Jeppson said the old Ordinance required the destruction to be seventy-five percent. He stated that the proposed code went into much greater detail concerning violations. Mr.Jeppson stated that the new Ordinance allowed the parking of boats,RV's,and trailers within enclosed side and rear yards.He said if they were stored outside,they needed to be stored behind a six-foot high screen wall or landscape wall. Mr.Jeppson stated that they would be permitted to be parked in the front yard for not more than two days or occupied for not more than three days. He stated that there was also a limit of four non-consecutive two day periods within a calendar year. Mr.Jeppson said the home occupation section of the code was more explicit regarding what would be permitted. He stated the Commission recommended using a Land Disturbance Ordinance instead of a Hillside Ordinance. Mr. Jeppson explained that the new code would allow a disturbance area of up to four times the size of the foot print of the residence,with several stipulations. He said that the allowable excavation ratio without a retaining wall would be 3:1 on property with a slope of 15% or greater. Mr.Jeppson stated that the sign regulations would be under a new format. He reviewed the signage that would be allowed in the different zoning districts. Mr. Jeppson explained the parking section of the new zoning code. He stated there were minimal changes in the outdoor lighting section of the code. Mr.Henry asked if signs would be allowed on public right-of-ways. Mr.Jeppson stated they would not be allowed. Mr. Henry said there were many directional signs on Saguaro Boulevard for MCO and it's projects. Mr.Jeppson said the Town was going to decide if the signs were going to be removed or controlled by the Town. Vice Mayor Fox requested a timetable for review of the Ordinance. Councilman Hudson suggested the proposed code be reviewed during the next two or three work study sessions of the Council. AGENDA ITEM#7 - CALL TO THE PUBLIC. Mayor Cutillo made the call to the public and there was no comment. Mayor Cutillo stated that at 7:00 p.m.the following evening there would be a public information meeting at the Pinal County Facility in Apache Junction. He said it was for the identification of the six sites for the Maricopa County Land Fill. AGENDA ITEM #8 - PURSUANT TO A.R.S. 38-431.03.A.7. AND 38-431.03.A.3, VOTE TO GO INTO Minutes of the Town Council Special Session - 07/14/92 Page 2 of 3 EXECUTIVE SESSION TO CONSULT WITH DESIGNATED REPRESENTATIVES OF THE PUBLIC BODY IN ORDER TO CONSIDER ITS POSITION AND INSTRUCT ITS REPRESENTATIVES REGARDING NEGOTIATION FOR THE PURCHASE OR LEASE OF REAL PROPERTY AND DISCUSSIONS OR CONSULTATION FOR LEGAL ADVICE WITH THE ATTORNEY OR ATTORNEYS OF THE PUBLIC BODY, RESPECTIVELY. Councilman Minarsich made a MOTION to go into Executive Session. SECONDED by Councilwoman Tibbetts and CARRIED unanimously. The Mayor said the Council would take a brief recess before going into Executive Session. The Council adjourned to Executive Session at 7:30 p.m. AGENDA ITEM#9 - RETURN TO SPECIAL SESSION. The Fountain Hills Town Council returned to Special Session at 9:35 p.m. AGENDA ITEM#10 - ADJOURNMENT. Councilman O'Brien made a MOTION to adjourn.
