MINUTES OF THE SPECIAL AND EXECUTIVE SESSION OF THE
FOUNTAIN HILLS TOWN COUNCIL
AND JOINT MEETING WITH THE PLANNING & ZONING COMMISSION
JANUARY 17, 1995
A public meeting of the Fountain Hills Town Council and joint meeting with the Planning &Zoning Commission
was convened and called to order by Mayor Cutillo at 6:00 P.M., Tuesday,January 17, 1995,in the Fountain Hills
Town Hall Council Chambers, located at 16836 E. Palisades Blvd., Building C,Fountain Hills, Arizona.
ROLL CALL-Following the pledge to the flag and the invocation by Councilwoman Tibbetts,roll call was taken.
Present for roll call were the following members of the Fountain Hills Town Council: Mayor John Cutillo, Vice
Mayor Wally Hudson, and Councilmembers Don Lawrence, Peg Tibbetts, Frank Clark and Marianne Wiggishoff.
Councilman O'Brien arrived late. Also present were Town Manager Paul Nordin,Town Attorney Bill Farrell and
Town Clerk Cassie Hansen and Community Development Director Gary Jeppson.
AGENDA ITEM#2 - PURSUANT TO A.R.S. 38-431.03.A.1, VOTE TO GO INTO EXECUTIVE SESSION
FOR THE PURPOSE OF DISCUSSION OR CONSIDERATION OF EMPLOYMENT, ASSIGNMENT,
APPOINTMENT, PROMOTION, DEMOTION, DISMISSAL, SALARIES, DISCIPLINING OR
RESIGNATION OF A PUBLIC OFFICER, APPOINTEE OR EMPLOYEE OF ANY PUBLIC BODY,
Lov EXCEPT THAT WITH THE EXCEPTION OF SALARY DISCUSSIONS,AN OFFICER,APPOINTEE OR
EMPLOYEE MAY DEMAND THAT SUCH DISCUSSION OR CONSIDERATION OCCUR AT A PUBLIC
MEETING. THE PUBLIC BODY MUST PROVIDE THE OFFICER,APPOINTEE OR EMPLOYEE WITH
SUCH PERSONAL NOTICE OF THE EXECUTIVE SESSION AS IS APPROPRIATE BUT NOT LESS
THAN 24 HOURS FOR THE OFFICER, APPOINTEE OR EMPLOYEE TO DETERMINE WHETHER
SUCH DISCUSSION OR CONSIDERATION SHOULD OCCUR AT A PUBLIC MEETING. COUNCIL
WILL BEGIN INTERVIEWING APPLICANTS FOR THE PARKS AND RECREATION COMMISSION
AT 6:00 P.M. THE JOINT MEETING WILL BEGIN AT APPROXIMATELY 8:00 P.M.
Vice Mayor Hudson MOVED to go into Executive Session pursuant to A.R.S. 38-431.03.A.1. Councilwoman
Tibbetts SECONDED the motion which CARRIED unanimously. Mayor Cutillo recessed the Special Session of
the Town Council at 6:01 P.M. to go into Executive Session for interviews with Parks and Recreation Commission
applicants.
AGENDA ITEM 3 - RETURN TO SPECIAL SESSION.
Mayor Cutillo declared the Executive Session of the Town Council closed and reconvened the Special Session of
the Town Council at 8:15 P.M.

THE PLANNING AND ZONING COMMISSION TO DISCUSS THE 1995 PROGRAM OF WORK
PROPOSED BY CHAIRMAN THOMAS FOR THE PLANNING AND ZONING COMMISSION.
Mayor Cutillo called the Joint Meeting of the Town Council and the Planning and Zoning Commission to order.
Members of the Planning & Zoning Commission present included Chairman Thomas, Vice Chairman Klesner and
Commissioners VanSant, Gelinas, Saar, Myers and Hansen.
Chairman Thomas presented his proposed program of work and discussed areas of responsibility included which
include zoning,subdivision ordinance,landscape/streetscape plan,general plan,town center specific plan,commercial
and real estate development.
Attorney Farrell provided background information detailing the purpose of zoning and duties of the Planning &
Zoning Commission. He stated the advisory capacity of the P&Z Commission pertaining to rezoning issues was their
principal responsibility. The administration and annual revision of the General Plan as stated in the Town Code was
an additional responsibility of the P&Z Commission. He said that if there were a proactive role of the P&Z
Commission it would be through the General Plan. In the event that zoning variances or changes were continually
requested, commissioners could propose revisions or amendments to the Zoning Ordinance for consideration.
Mayor Cutillo said he thought the P&Z Commission should work on zoning matters and the subdivision ordinance
but really had no role in the Town Center, economic and commercial development.
Commissioner Myers was concerned with the inconsistency between the Zoning Map and the land use map in the
General Plan. She asked if built out,population figures would be 70,000 or 40,000 people if the current Zoning Map
was followed. She also questioned legal aspects of density changes in zoning.
Vice Mayor Hudson said the Council had previously directed staff to begin identifying the discrepancies between
itior the Zoning Map and the General Plan, starting with all commercial areas.
Mayor Cutillo stated that the Zoning Map was the official land use map where the General Plan was used as a
guideline.
Attorney Farrell pointed out that General Plan amendments had been forwarded to him for review. He said that the
General Plan(land use map)should indicate the combinations of zoning districts acceptable in different areas of the
town. At that time the Zoning Map would be the result of specified zoning districts in those areas. Also land
developed prior to incorporation should remain zoned as built. The two maps would not be identical until the Town
was developed to capacity.
Councilwoman Wiggishoff pointed out that there were other areas of inconsistency when owners built a less-dense
home without rezoning and that in those instances, the zoning change should reflect the applicable zoning. There
was much discussion regarding this issue.
Commissioner Myers spoke regarding the P&Z Commission's role in reviewing the Subdivision Ordinance in order
to make recommendations to the Council for changes or additions. Environmentally-sensitive land areas were also
discussed.
Additional discussion continued about the various bodies of government,i.e.,Rural Metro,Sanitary Board and School
District officials working together with Town officials regarding the impact of growth and development on utilities,
services, etc.

Susan Ralphe, Chairman of the Citizens Committee to Preserve the Natural Environment addressed the landscape
416, and streetscape ordinances. She suggested that native desert plants currently in the washes be included in any
landscape ordinance. Attorney Farrell stated that there were regulations enforced by the State regarding protection
of desert vegetation.
Mayor Cutillo concluded the discussions by restating that the Council felt Items 1, 2, 3 and 4 in Mr. Thomas's
proposed program of work should be considered as primary areas of responsibility, those being zoning, subdivision
ordinance,landscape ordinance/streetscape plan and general plan. Plan Commission members could be asked to act
as a liaison for future committees involving items 5, 6 and 7, i.e., Town Center Specific Plan, commercial and
economic development.
AGENDA ITEM 5- CALL TO THE PUBLIC. PUBLIC COMMENT IS ENCOURAGED BUT PLEASE BE
ADVISED THAT THE COUNCIL HAS NO ABILITY TO RESPOND OR DISCUSS MATTERS BROUGHT
UP DURING THE CALL TO THE PUBLIC AS SUCH DISCUSSION IS PROHIBITED BY THE ARIZONA
OPEN MEETING LAW.
No one came forward.
AGENDA ITEM 6 - ADJOURNMENT.
Councilman Lawrence MOVED to adjourn the meeting. Councilman Clark SECONDED the motion which
CARRED unanimously. The meeting adjourned at 10:17 P.M.
