MINUTES OF THE SPECIAL SESSION OF THE
FOUNTAIN HILLS TOWN COUNCIL
SEPTEMBER 28,1999
A public meeting of the Fountain Hills Town Council was convened and called to order by Mayor Morgan at 6:00 P.M.,
Tuesday, September 2861, 1999, in the Fountain Hills Town Hall Conference Room, located at 16836 E. Palisades Blvd.,
Building C,Fountain Hills,Arizona.
Mayor Morgan called the special session of the Town Council to order.
ROLL CALL: Present for roll call were the following members of the Fountain Hills Town Council: Mayor Sharon
Morgan, Vice Mayor Pen Mower and Councilmembers, Sid Apps and Al Poma. Also present were the Town Clerk
Cassie Hansen, Director of Community Development Jeff Valder, and Building Safety Inspector Mike Stevens. The
following members of the Fountain Hills Town Council were absent: Councilmembers John Wyman, Sharon Hutcheson,
and Marianne Wiggishoff.
AGENDA ITEM #1 — CONSIDERATION OF THE LIQUOR LICENSE APPLICATION SUBMITTED BY
ENRICO CUOMO FOR MAMA'S PIZZA CUCINA LOCATED AT 16852 EAST PARKVIEW. THE
APPLICATION IS FOR A NEW CLASS#12 RESTAURANT LIQUOR LICENSE.
Vice Mayor Mower MOVED to approve the liquor license application. Councilman Apps SECONDED the motion.
Director Valder explained staff had been reviewing the liquor license application and a tenant improvement application at
the same time and the Liquor License had been held up while staff clarified the floor plan issues.
He said staff had questioned whether or not any other improvements to the structure would have to be made as it related
,to the class of liquor license applied for. The majority of the area that was to be a dining room had been significantly
reduced. He reviewed the code, which states that the occupancy load couldn't exceed occupancy of 50 in order to avoid
complying with internal restrooms and ADA requirements. So, most of the new space would be prohibited for use as
dining room seating, which included the outside area. He stated it was his understanding from the Town's plan reviewer,
Mike Stevens, that they had reviewed the plans and made the seating area only as large as would allow for a maximum
occupancy of 50. He acknowledged that although there was a future expansion area indicated on the plans, it could only
be used according to the Town's codes and would need to meet ADA requirements and address the issue of restrooms.
Director Valder indicated staff had issued a tenant improvement for the site and those improvements would be under way
soon. He stated the applicant had complied with all the building plan requirements and therefore, staff recommended
approval of the liquor license application.
Councilman Poma asked if the restrooms would still be in the back of the restaurant. Director Valder said yes.
Councilman Poma commented he thought the Liquor Department would have had a problem with the placement.
Councilman Poma and Vice Mayor Mower agreed the applicant had complied with the Town's requirements.
Town Clerk Cassie Hansen stated the Town's Liquor Agent had been questioned about the layout and design of the
restaurant floor plan and that was when the agent provided her with the eight criteria for issuing restaurant licenses under
Title 4. She said the agent's bottom line was the Liquor License Department didn't care about the layout as long as 40%
of the sales were generated from food. He had also made the comment that the Liquor Department didn't care if there
were out houses in the back.
Mayor Morgan reiterated the applicant had met the Town's requirements for the liquor license that he was requesting.
Director Valder said yes.
vlayor Morgan asked for a vote on the motion. The motion CARRIED unanimously.

Vice Mayor Mower MOVED to adjourn the meeting. Councilman Apps SECONDED the motion, which CARRIED
unanimously. Mayor Morgan adjourned the meeting at 2:35 p.m.
