MINUTES OF THE SPECIAL AND EXECUTIVE OF THE
Ls, FOUNTAIN HILLS TOWN COUNCIL
November 19,2002
Mayor Beydler called the meeting to order at 5:00 p.m.
ROLL CALL -Present for roll call were the following members of the Fountain Hills Town Council: Mayor Jon Beydler,
Vice Mayor Leesa Fraverd, and Councilmembers Rick Melendez, Susan Ralphe, Kathleen Nicola, Michael Archambault,
and John Kavanagh. Town Attorney Andrew McGuire, Town Manager Tim Pickering, Director of Administration Town
Clerk Cassie B.Hansen and Steve Guttell from Gust Rosenfeld were also present.
AGENDA ITEM #1 — PURSUANT TO A.R.S. §38-731.03.A.4., VOTE TO GO INTO EXECUTIVE SESSION
FOR: DISCUSSION OR CONSULTATION WITH THE ATTORNEYS OF THE PUBLIC BODY IN ORDER TO
CONSIDER ITS POSITION AND INSTRUCT ITS ATTORNEYS REGARDING THE PUBLIC BODY'S
POSITION REGARDING CONTRACTS THAT ARE THE SUBJECT OF NEGOTIATIONS, IN PENDING OR
CONTEMPLATED LITIGATION OR IN SETTLEMENT DISCUSSIONS CONDUCTED IN ORDER TO
AVOID OR RESOLVE LITIGATION, SPECIFICALLY SETTLEMENT IN THE HOFFMAN VS. TOWN, ET
AL LITIGATION.
Councilwoman Ralphe MOVED to recess the special session and convene the executive session. Vice Mayor Fraverd
SECONDED the motion, which CARRIED unanimously.
AGENDA ITEM#2—RETURN TO SPECIAL SESSION.
AGENDA ITEM #3 — CONSIDERATION AND POSSIBLE ACTION ON SETTLEMENT OF ALL OR A
PORTION OF HOFFMAN VS.TOWN,ET AL LITIGATION.
,,uncilman Archambault MOVED to approve a settlement for Hoffman vs. the Town of Fountain Hills et al in the
.nount of$140,000 and Councilwoman Nicola SECONDED the motion.
A roll call vote was taken with the following results:
Mayor Beydler Aye Councilman Melendez Aye
Vice Mayor Fraverd Nay Councilman Archambault Aye
Councilwoman Nicola Aye Councilman Kavanagh Aye
Councilwoman Ralphe Nay
The motion CARRIED on a vote of 5 —2. Vice Mayor Fraverd and Councilwoman Ralphe cast the nay votes.
AGENDA ITEM#4-ADJOURNMENT.
Vice Mayor Fraverd MOVED to adjourn the meeting and Councilman Kavanagh SECONDED t - motion. The motion
