MINUTES OF THE SPECIAL AND EXECUTIVE SESSION OF THE
FOUNTAIN HILLS TOWN COUNCIL
JULY 25,2005
Mayor Nichols called the meeting to order at 9:05 a.m.
ROIL CALL — Present for roll call were the following members of the Fountain Hills Town Council:
Councilmember Archambault, Councilmember Kehe, Councilmember Kavanagh, Vice Mayor Schlum and
Councilmember McMahan. Mayor Nichols was absent. Town Attorney Andrew McGuire, Town Manager
Tim Pickering, and Town Clerk Bev Bender were also present.
AGENDA ITEM #1 - ROLL CALL AND VOTE TO GO INTO F.XECIJTiVE. SESSION:
PURSUANT TO A.R.S. t;+38-431-03.A.4, DISCUSSION OR CONSULTATION WITH THE,
ATTORNEYS OF THE PUBLIC BODY iN ORDER TO CONSiDF.R ITS POSITION AND
INSTRUCT iTS ATTORNEYS REGARDING THE PUBLIC BODY'S POSITION REGARDING
CONTRACTS THAT ARE THE SURiECT OF NEGOTIATIONS, iN PENDING OR
CONTEMPLATED LITIGATION OR iN SETTLEMENT DISCUSSIONS CONDUCTED IN
ORDER TO AVOiD OR RESOLVE LITIGATION. (SPECIFICALLY, THE LOCAL
GOVERNMENT INVESTMENT POOL iJTIGATiON1
Councilman Archambault MOVED to convene the Executive Session and Councilmember McMahan
SECONDED the motion, which CARRIED UNANIMOUSLY(5 to 0).
AGENDA ITEM#2-RETURN TO SPECIAL SESSION
Councilmember Kavanagh MOVED to recess the Executive Session at 9:10 a.m. and Councilmember
Archambault SECONDED the motion, which CARRIED UJNANiMOUJSLY (5 to 0).
AGENDA ITEM #3 - CONSIDERATION OF APPROVING A PARTIAL SETTLEMENT WiTH
REGARD TO THE LOCAL GOVERNMENT INVESTMENT POOL LITIGATION,
Councilman Archambault MOVED to approve the settlement with Deloitte and Touchd, L.L.P. for the
appropriate percentage to which the Town was entitled and Councilmember McMahan SECONDED the
motion,which CARRIED UNANIMOUSLY (5 to 0).
AGENDA ITEM#4- ADiOUJRNMENT,
Councilman Archambault MOVED to adjourn and Councilmember Kavanagh SECONDED the motion to
adjourn at 9:11 a.m.,which CARRIED IJNANIMOIISLY(5 to 0).
