MINUTES OF THE EXECUTIVE AND SPECIAL SESSION OF THE
FOUNTAIN HILLS TOWN COUNCIL
JULY 3,2008
Mayor Schlum called the meeting to order at 11:00 a.m.
AGENDA ITEM #1 — ROLL CALL AND VOTE TO GO INTO EXECUTIVE SESSION: Pursuant to
§38-431.03(A)(4), for discussion or consultation with the attorney or attorneys representing the Town in order
for the Council to consider its position and instruct its attorneys regarding the Council's position regarding
pending litigation (Specifically, legal advice regarding Sklar v. Town of Fountain Hills litigation).
ROLL CALL - Present for roll call were the following members of the Fountain Hills Town Council: Mayor
Jay Schlum, Vice Mayor Henry Leger, Councilmember Mike Archambault, Councilmember Cassie Hansen, and
Councilmember Dennis Contino. Interim Town Manager Kate Zanon and Acting Town Clerk Janice Baxter
were also present. Councilmember Ginny Dickey, Attorney Andrew McGuire, and Town Manager Rick Davis
attended via conference call. Councilmember McMahan was absent.
Councilmember Mike Archambault MOVED to convene the Executive Session and Vice Mayor Henry Leger
SECONDED the motion, which CARRIED UNANIMOUSLY.
AGENDA ITEM#2—ADJOURNMENT OF EXECUTIVE SESSION
Councilmember Mike Archambault MOVED to adjourn the Executive Session at 11:35 a.m. and Vice Mayor
Henry Leger SECONDED the motion, which CARRIED UNANIMOUSLY.
SPECIAL SESSION
LirMayor Jay Schlum convened the Special Session at 11:50 a.m.
ROLL CALL—Present for roll call were the following members of the Fountain Hills Town Council: Mayor
Jay Schlum, Vice Mayor Henry Leger, Councilmember Mike Archambault, Councilmember Cassie Hansen, and
Councilmember Dennis Contino. Interim Town Manager Kate Zanon and Acting Town Clerk Janice Baxter
were also present. Councilmember Ginny Dickey, Attorney Andrew McGuire, and Town Manager Rick Davis
attended via conference call. Councilmember McMahan was absent.
AGENDA ITEM #3 — DISCUSSION AND POSSIBLE DIRECTION TO THE TOWN ATTORNEY
REGARDING THE SKLAR V.TOWN OF FOUNTAIN HILLS LITIGATION.
Mayor Jay Schlum asked for a Motion to approve the direction to the Town Attorney as discussed in Executive
Session on July 3, 2008.
Councilmember Mike Archambault MOVED to direct the Town Attorney to move forward with litigation as
recommended in Executive Session. Councilmember Dennis Contino SECONDED the motion, which
CARRIED UNANIMOUSLY by a majority of those present(6-0).
AGENDA ITEM#4-ADJOURNMENT
Councilmember Dennis Contino MOVED to adjourn the meeting at 11:52 a.m. and Councilmember Mike
Archambault SECONDED the motion, which CARRIED UNANIMOUSLY by a majority of those present(6-
0).
