ORDINANCE #96-07
AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN
OF FOUNTAIN HILLS, ARIZONA, AMENDING CHAPTER 15 OF THE
FOUNTAIN HILLS TOWN CODE TITLED, SUBDIVISIONS, AND COMMONLY
KNOWN AS THE FOUNTAIN HILLS SUBDIVISION REGULATIONS BY
AMENDING SECTION 3.09(B)(4), TO AMEND THOSE REGULATIONS
DESCRIBING LIMITATIONS ON CUT AND FILL GRADING.
BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. Article III, Section 5.11(B)(4) Limitations on Cut and Fill is amended and is to
read as follows:
4. Limitations on Cut and Fill. With the exception of feat4way grading for
the construction of public roads or private roads meeting public road
standards, the height of any fill or the depth of any cut area, as measured
from the natural grade or subdivision finished grade (if the property is
platted after September 20, 1991, shall not be greater than ten (10) feet
regardless of whether the fill or cut is retained, unretained, or a
combination thereof. The total combined height of any fill or the depth of
any cut area as a result of subdivision improvement grading and/or any
subsequent grading, including but not limited to grading approved as a part
of building permit approval, shall not total more than ten (10) feet, as
measured from natural grade. These limitations on cut and fill apply to all
Zoning Districts. These limitations may be waived by the Town
Council.
