HomeMy WebLinkAboutOrd 1996-13 TOWN OF FOUNTAIN HILLS ORDINANCE #96-13 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING CHAPTER 15 OF THE FOUNTAIN HILLS TOWN CODE TITLED, SUBDIVISIONS, AND COMMONLY KNOWN AS THE FOUNTAIN HILLS SUBDIVISION REGULATIONS BY AMENDING SECTION 102,DEFINITIONS,AND;BY AMENDING SECTION 303. STREETS AND HIGHWAYS, AND; BY DELETING PLATE 2 AND ADDING PLATES 2A, 2B, 2C, 2D, 2E, 2F, AND 2G, AND; BY ADDING SECTION 3.04(A), AND; BY DELETING PLATE 10 AND ADDING PLATE 10A, 10B AND 10C TO AMEND THOSE REGULATIONS DESCRIBING THE DESIGN OF ROADWAYS AND THE DESIGN, MAXIMUM USE AND MAXIMUM LENGTH OF CUL-DE- SAC ROADWAYS, AND; REPEALING ORDINANCE 95-12. BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS: Section 1. Article I, Section 102.00. Definitions is amended (text to be added is shown as shaded and text to be deleted is shown as crossed out), and is to read as follows: L ARTICLE I. TITLE, PURPOSE AND DEFINITIONS 102.00. Definitions For the purposes of these Regulations, certain words, terms and phrases are defined as follows: 41. Streets: That area, whether public or private, between right-of-way lines, dedicated, reserved or provided for roadway purposes and other uses not inconsistent therewith. A public street must be accepted by the Town Council prior to acknowledgement that said street is a public street. A private street must be contained in a recorded plat or horizonal property regime. Arterial Route: A general term including freeways, expressways and arterial streets; an interstate, state, or county highway having regional continuity; any urban street having considerable continuity and carrying a large volume of both passenger and commercial vehicles. These arterial routes are normally on the section lines. b. Residential Streets: (1) Collector Street: A neighborhood street with limited continuity and having the primary function of carrying residential traffic from minor streets to arterial routes; a secondary function being to provide access to abutting residential properties. (2) Frontage Street: A minor street parallel and adjacent to an arterial route which provides access to abutting property, intercepts minor residential streets and controls access to an arterial route. (3) Minor Street: A street used primarily for providing access to abutting property. (4) Cul-de-sac Street: A minor residential street having one end A street or combination of streets, built to hillside local, local or minor collector roadway standards that must utilize the same roadway segment to gain ingress or egress from/to a Limited Collector, major collector or arterial roadway or to a "through street". {5) Loop Street: A minor residential street which forms a loop and returns to the same street from which it originated. (5) Limited Collector Street: A street built to Town Limited Collector roadway standards that: has an 82 foot right-of-way, and; that has a maximum length of 2,000 linear feet, and; which must intersect a major collector or an arterial roadway, and; that can only be developed at the discretion of the Town Council to provide access to a cul-de-sac subdivision. (6) Through Street: A street or combination of streets built to Town hillside local, local or minor collector roadway standards that have two separate (300 foot minimum separation) and distinct routes of ingress and egress from/to limited collector, major collector and/or arterial roadways. The final plat must contain the certification called for in Article II, Section 207, Paragraph 22 of these Regulations; streets; 1. That adequate provision is made for access of emergency vehicles,utility vehicles, b ; 5. That clear statements be contained in both deed restrictions and homeowners' association by laws that those streets are declared private and remain the permanent responsibility of the homeowner's association; adequately served thereby; and 7. That the health, safety and welfare of the public will not be impaired thereby. ORDINANCE 96-13 PAGE 4 OF 21 303. Street Location and Arrangement. l Street layout shall provide for the continuation of such streets as the GeneralPlan; the Town Council or Engineering Department may designate. 2 There shall be no development of roadways built to collector or arterial standards unless that roadway development and precise roadway alignment is separately approved by, and at the sole discretion of, the Town Council prior to preliminary plat approval: 3: No;street shall be approved as a "half street The boundaries of a subdivision or a separate concurrent dedication shall provide for the full width of any necessary street dedication.- Exceptions to the regulation shall only be granted when an existing half street dedication adjoining a proposed subdivision is in place and the Town is thereby assured of a full street right-of-way dedication upon approval of thefinal plat: 4 Certain proposed streets, as designated by the Town,shall be extended to the tract botindaryr^to provide future connection with adjoining unsubdivided lands: 5• Lo`caI streets shall be so arranged as to discourage their use by through traffic 6 Where a proposed subdivision abuts or contains an existing or proposed arterial ormajor collector right-of-way, non-buildable parcels equaling at least the depth of the minimum street side-yard setback of the-base zoning distract, or twenty (20) feet, whichever is greater, shall be platted with Non-Vehicular Access Easements along-the-arterial or major collector right-of-way. ' Other treatment as may be justified for protection of residential properties from the nuisance and hazard of "high volume traffic, and to preserve the traffic function of the arterial or collector street may be required by the Town Engineer. 7 Where a subdivision abuts or contains the right-of-way of a limited access highway or abuts a commercial or industrial;land use, the subdivider May be required to locate a street approximately parallel to and on each side of such right- of way at a distance suitable for appropriate use of the`'intervening and/Such distance shall be determined with due regard for approach grades, drainage, bridges or future grade separations. 8 Streets shall be so arranged in relation to existing topography as to produce desirable lots of maximum utility, streets of reasonable gradient, and the facilitation of adequate drainage. Alleys are not required in residential subdivisions, except that the Commission may require that they be"dedicated in certain situations to complete existing patterns or to serve as secondary access to adjacent properties.' .Alleys may be required in commercial and industrial subdivisions as approved by the Town Councih 10 Where private streets are. approved through the 'Planned Unit Development Process,such'streets shall be constructed to Town public street specifications and shall be'placed into specific "street tracts" of land. Statements shall be contained on the plat and in both the deed restrictions and the homeowners association'^by- laws that those streets are declared private subject td an easement authorizing;use by emergency and public service vehicles, and remain the permanent responsibility of the homeowners association. If at any time the streets are'dedicated to and accepted by the Town, the'streets must first be developed to at least the minimum standards specified by the Town at the time of dedication:' Section 3. Article 304. Cul-De-Sac Street Design is added (text to be added is shown as shaded and text to be deleted is shown as crossed out), and is to read as follows: Section 304. Street and Block Design The design of cul-de-sac streets shall conform toxthe following standards: A Hillside-local cul-de-sac streets shall terminate in a circular right-of-way, forty.feet (40') in radius, with an improved traffic turning circle thirty-five (35')in radius (See Plate 10A). B. Local and minor collector cul-de-sac streets shall terminate in a circular right-of-way, forty-five feet':(45') in radius, with an improved traffic turning circle forty(40') in radius (See Plate 1 OB). C. Maximum length of cul-de-sac streets. The following types of roads are notcul-de-sacs, nor shall they be included in the ultimate length of a cul-de-sac: A "through street" as defined in Article I that is built to Town hillside local, local or minor collector roadway standards,or; a limited collector road built to Town limited collector road standards, or; a major collector road built to Town major collector road standards, or; an arterial road built to Town arterial road standards. 2. Cul-de-sac streets built to hillside-local road standards shall not exceed one thousand five hundred (1,500) feet in length, nor shall the cul-de-sac have more than fifteen (15) lots or units (See Plate I OA). 3` Cul-de-sac streets built to local and minor collector road standards shall not exceed one thousand five hundred (1,500) feet in length, nor shall the cul-de-sac have more than twenty-five (25) lots or units (See:Plate 10B) 4. The ultimate, cumulative length of µa cul-de-sac street or streets shall be measured from the intersection of right-of-way lines of the cul-de-sac street`and that of either.'a "through street", limited collector, major collector or arterial roadway to the end(s) of the turning circle(s) of the cul-de-sac bulb(s) along the street centerline (See Plates 10A,>1013 and 10C) ORDINANCE 96-13 PAGE 15OF21 5. Limited collector`'roadways shall not be longer than 2,000 linear feet as measured from the intersection of the roadway from a major collector or arterial roadway Limited collector roadways are`not included in cul-de-sac length,but not more than 90 lots shall utilize this roadway for.'vehicular access beginning from the point at which the limited collector intersects with a major collector or arterial roadway.-The development of and the precise alignment of limited collector roadways can only be approved at the discretion of the Town Council Limited collector roadways shall only be used to provide access to a cul-de-sac-subdivision located within a single family zoning district ;x Separate Town Council approval of the use and exact alignment of limited Collector roadways must be gained prior to preliminary plat-approval of the subdivision within which the limited collector is proposed. (See Plate 10C) 6. The utilization of,emergency secondary access comd ors,'which are more ;than one hundred.,(100) feet long shall not relieve `the subdivider of the requirements of this section, and shall not,be cause`;to increase the maximum length or lot numbers on a cul-de- sac street. • Section 5.
