AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING THE ZONING
ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS PURSUANT
CHAPTER 2, SECTION 2.01, AMENDING "THE OFFICIAL ZONING
DISTRICT MAPS" FOR FOR PARCEL#14 OF THE EAGLE MOUNTAIN
MASTER SUBDIVISION PLAT FROM "R-3" TO "R1-6A"
WHEREAS Chapter 2, PROCEDURES. Section 2.01, Amendments or Zone Changes.
establishes the authority and procedures for amending the zoning ordinance; and
WHEREAS The Town of Fountain Hills advertised with public notices of a size that were one-
eighth page or greater in size, in the official newspaper of general circulation, the
Times of Fountain Hills, on April 10, 17, 24 and May 1, 1996, public hearings
held by the Fountain Hills Planning and Zoning Commission on April 25, 1996
and by the Fountain Hills Town Council on May 2, 1996, to invite comments
from the public; and
WHEREAS Parcel #14 of the Eagle Mountain Master Subdivision Plat is zoned "R-3" and
therefore allows multi-family development; and
WHEREAS The property owner, Eagle Mountain Investors, LLC, desires to have Parcel #14
of the Eagle Mountain Master Subdivision Plat develop as a single-family
detached development; and
WHEREAS Eagle Mountain Investors, LLC desires to have Parcel #14 of the Eagle Mountain
Master Subdivision Plat zoned "R1-6A"; and
NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. The Official Zoning Districts Maps is hereby amended to change the zoning
district designation of Parcel #14 of the Eagle Mountain Master Subdivision Plat
from "R-3" to "R1-6A" as shown in Attachment "A"
