AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING THE CHAPTER
12, COMMERCIAL ZONING DISTRICTS OF THE ZONING ORDINANCE
FOR THE TOWN OF FOUNTAIN HILLS BY PERMITTING BUILDING
MATERIAL BUSINESSES, AND PRINTING, LITHOGRAPHY, AND
PRINTING ESTABLISHMENTS,IN THE "C-2" ZONING DISTRICTS,BY
AMENDING SECTION 12.05 USES SUBJECT TO SPECIAL USE
PERMITS IN C-2 ZONING DISTRICTS ONLY.
WHEREAS The Town of Fountain Hills adopted Ordinance #93-22, on November 18, 1993,
which adopted the Zoning Ordinance for the Town of Fountain Hills; and
WHEREAS Chapter 2, Section 2.01 of the Zoning Ordinance for the Town of Fountain Hills,
provides for a procedure to amend said ordinance, and
WHEREAS The Town of Fountain Hills desires in permit building material businesses and
printing, lithography, and printing establishments by special use permit only in the
"C-2" zoning district; and
WHEREAS The procedures detailed in Chapter 2, Section 2.01 of the Zoning Ordinance for
the Town of Fountain Hills has been followed; and
WHEREAS The Town of Fountain Hills has provided notice to the public by advertising these
proposed changes in the official newspaper of general circulation, The Times of
Fountain Hills on April 24, 1996, May 1, 1996, May 8, 1996 and May 15, 1996,
pursuant to Arizona Revised Statutes §9-462.04; and
WHEREAS The Planning and Zoning Commission held a public hearing on May 9, 1996 and
the Town Council held a public hearing on May 16, 1996 on this proposed
amendment.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. Revisions to Chapter 12 Section 12.05 of the Zoning Ordinance for the Town of
Fountain Hills is amended as follows, with the strike-out areas showing deletions
and the shaded areas showing new language:

12.05 Uses Subject to Special Use Permits in C-2 Zoning Districts Only:
lbw A. Art metal and ornamental iron shops.
B. Building and landscape material sales, provided all incidental equipment and
supplies are kept within a completely enclosed building or within an area enclosed
on all sides by a solid fence or wall at least six (6) feet in height, and no goods,
materials or objects are visible above the wall.
RC. Cabinet and carpentry shops.
€D. Nurseries, flower and plant sales, provided all incidental equipment and supplies
including fertilizer and empty cans, are kept within a completely enclosed building
or within an area enclosed on all sides by a solid fence or wall at least six (6) feet
in height and no goods, materials or objects are stacked higher than the fence or
wall so erected.
E. Printing, lithography and publishing establishments.
DF. Rental services: Household construction, landscaping, sickroom or office
equipment; but not equipment customarily used for heavy construction. Outdoor
storage must be screened from public and adjoining property view.
EG. Taxidermists.
FH. New and used automobile, including outside display area, provided all sales and
repair activities are conducted within a building.
PASSED AND ADOPTED BY the Mayor and Common Council of the Town of Fountain Hills,
Arizona, this sixteenth day of May, 1996.
