ORDINANCE 96-22
AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING THE TEXT OF
THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS,
ARIZONA PURSUANT TO CHAPTER 2,SECTION 2.01 OF THE ZONING
ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS, AND BY
AMENDING THE OFFICIAL ZONING DISTRICTS MAP OF THE TOWN
OF FOUNTAIN HILLS BY DESIGNATING THE PROPERTY AS
DESCRIBED IN ATTACHMENT "A" FROM "R-3" MULTI-FAMILY
RESIDENTIAL ZONING DISTRICT TO "R1-10" SINGLE FAMILY
ZONING DISTRICT.
WHEREAS, The Town of Fountain Hills adopted Ordinance #93-22, on November 18, 1993,
which adopted the Zoning Ordinance for the Town of Fountain Hills; and
WHEREAS, Chapter 2, PROCEDURES. Section 2.01, Amendments or Zone Changes.
establishes the authority and procedures for amending the zoning district
boundaries; and
WHEREAS, Chapter 3 ESTABLISHMENT OF ZONING DISTRICTS AND
BOUNDARIES THEREOF, Section 3.02 Boundaries Lines on the Zoning
Districts Maps. establishes the "Official Zoning Districts Map"; and
WHEREAS, Public hearings were advertised in the May 8, 1996, May 15, 1996, May 22, 1996,
May 29, 1996 and June 5, 1996 editions of The Times of Fountain Hills and Rio
Verde, pursuant to Arizona Revised Statutes §9-462.04, and
WHEREAS, Public hearings were held by the Fountain Hills Planning and Zoning Commission
on May 23, 1996 and the Mayor and Common Council on June 6, 1996; and
WHEREAS, The Future Land Use Plan in the "Fountain Hills General Plan" designates the
property described in Attactment "A", as a Multi-Family/Medium Residential.

NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. The "Official Zoning Districts Map" shall be amended to change the Zoning
District designation the property as described in Attachment "A", from "R-3",
Multi-Family Residential Zoning District to "R1-10", Single Family Residential
Zoning District.
PASSED AND ADOPTED BY the Mayor and Common Council of the Town of Fountain Hills,
Arizona, this 6th day of May, 1996.

A portion of the Southwest quarter of Section 15, Township 3 North, Range 6 East of the Gila
and Salt River Base and Meridian, Maricopa County, Arizona, and more particularly described as
follows:
COMMENCING at the intersection of Fountain Hills Boulevard and Segundo Drive as shown on
Fountain Hills Arizona Final Plat No. 206 as recorded in Book 147, Page 2, Maricopa County
Records;
THENCE North 23 degrees 53 minutes 00 seconds West along the monument line of Fountain
Hills Boulevard a distance of 167.41 feet;
THENCE departing said monument line North 72 degrees 00 minutes 00 seconds West a distance
of 73.87 feet to the POINT OF BEGINNING, said point being also on the Westerly right of way
line of Fountain Hills Boulevard;
THENCE North 72 degrees 00 minutes 00 seconds West along the Southerly line of Colony
Wash a distance of 475.98 feet to the beginning of a tangent curve concave Northerly and having
a radius of 650.00 feet;
THENCE along the arc of said curve through a central angle of 13 degrees 18 minutes 00 seconds
an arc length of 150.88 feet;
THENCE North 58 degrees 42 minutes 00 seconds West a distance of 400.51 feet to the
beginning of a tangent curve concave Southerly and having a radius of 450.00 feet;
THENCE along the arc of said curve through a central angle of 40 degrees 23 minutes 00 seconds
> an arc length of 317.17 feet;
THENCE South 80 degrees 55 minutes 00 seconds West a distance of 6.40 feet to the Easterly
right of way line of Mountainside Drive as shown on Fountain Hills Arizona Plat No. 601—A and i
recorded in Book 161, Page 44, records of Maricopa County, Arizona;
THENCE departing the Southerly line of said wash South 09 degrees 05 minutes 00 seconds East
along said line of Mountainside Drive a distance of 200.00 feet to the beginning of a tangent curve
concave Northeasterly and having a radius of 20.00 feet;
THENCE along the arc of said curve through a central angle of 90 degrees 00 minutes 00
seconds, an arc length of 31.42 feet to the Northeast corner of Thistle Drive;
THENCE South 09 degrees 05 minutes 00 seconds East a distance of 60.00 feet to the Southeast
corner of Thistle Drive;
THENCE departing Thistle Drive and continuing South 09 degrees 05 minutes 00 seconds East a
distance of 125.35 feet (record: 125.84 feet) to the Northerly line of Fountain Hills Arizona Final
Plat No. 423 as recorded in Book 149, Page 31, Maricopa County Records;
THENCE North 80 degrees 51 minutes 50 seconds East along the Northerly line of said Plat No.
423 a distance of 125.71 feet (record: North 80 degrees 55 minutes 00 seconds East a distance of
125.66 feet);
THENCE South 61 degrees 11 minutes 42 seconds East a distance of 545.40 feet (record: South
61 degrees 12 minutes 56 seconds East a distance of 545.37 feet);
THENCE South 77 degrees 12 minutes 27 seconds East a distance of 524.10 feet (record: South
77 degrees 12 minutes 48 seconds East a distance 524.27 feet);
THENCE North 62 degrees 36 minutes 31 seconds East a distance of 155.40 feet (record: North
62 degrees 25 minutes 30 seconds East a distance of 155.32 feet) to the Westerly line of Fountain
Hills Boulevard;
