AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING THE ZONING
ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS PURSUANT
CHAPTER 2, SECTION 2.01, AMENDING "THE OFFICIAL ZONING
DISTRICT MAPS" FOR FOR PLAT#422, BLOCK#2, LOT#2,FROM "C-
1" TO "M-3 PLANNED UNIT DEVELOPMENT (P.U.D.)".
WHEREAS Chapter 2, PROCEDURES. Section 2.01, Amendments or Zone Changes.
establishes the authority and procedures for amending the zoning ordinance;
and
WHEREAS The Town of Fountain Hills advertised with public notices of a size that were
one-eighth page or greater in size, in the official newspaper of general
circulation, the Times of Fountain Hills, on July 24, 31, August 7 and 15,
1996, public hearings held by the Fountain Hills Planning and Zoning
Commission on January 8, 1996 and by the Fountain Hills Town Council on
August 15, 1996 and continued until September 5, 1996, to invite comments
from the public; and
iirre WHEREAS Plat #422, Block #2, Lot #2 is zoned "C-1" and therefore allows commercial
development; and
WHEREAS The property owner desires to have multi-family residential development on
this lot; and
WHEREAS New Amercian Builders, Inc desires to have Plat #422, Block #2, Lot #2,
zoned "M-3 Planned Unit Development Case #96-21"; and
NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. The Official Zoning Districts Maps is hereby amended to change the zoning district
designation of Plat #422, Block #2, Lot #2 from "C-1" to "M-3 Planned Unit
Development (Case #96-21)" as shown in Attachment "A"
