HomeMy WebLinkAboutOrd 1996-34 TOWN OF FOUNTAIN HILLS ORDINANCE #96-34 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, ADOPTING AMENDMENTS TO CHAPTER 7 OF THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS BY AMENDING SECTION 7.03 TO DISALLOW TANDEM PARKING SPACES TO MEET THE MINIMUM OFF-STREET PARKING REQUIREMENTS AND MANDATING CERTAIN SURFACING MATERIALS, PURSUANT TO CHAPTER 2, SECTION 2.01 OF THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS. WHEREAS, The Town of Fountain Hills adopted Ordinance #93-22, on November 18, 1993, which adopted The Zoning Ordinance for the Town of Fountain Hills, as Chapter 17 of The Code of the Town of Fountain Hills, and; WHEREAS, Chapter 2, Section 2.01 of the Zoning Ordinance for the Town of Fountain Hills, provides for a procedure to amend said ordinance, and; WHEREAS, The Town of Fountain Hills recognizes that tandem parking spaces are typically not utilized in the manner intended in that one of the two tandem parking spaces is often converted to other uses or not used at all, and; WHEREAS, The practice of permitting tandem parking has caused an inordinate amount of on- street parking, and; WHEREAS, The street widths in Fountain Hills do not accommodate on-street parking on both sides of a roadway and safe passage of two-way traffic at posted speed limits, and; WHEREAS, The Town of Fountain Hills desires to have a well-defined and all-weather surfaced parking areas for resident and guest vehicles, and; WHEREAS, The procedures detailed in Chapter 2, Section 2.01 of the Zoning Ordinance for the Town of Fountain Hills have been followed, and; WHEREAS, The Town of Fountain Hills has rewritten the text of Chapter 7 of the Zoning Ordinance of the Town of Fountain Hills and published these proposed text changes in the official newspaper of general circulation, The Times of Fountain Hills and Rio Verde, on October 30, 1996, November 6, 1996, November 13, 1996 and on November 20, 1996, and; AS /FAIL 11--) -Q� ORDINANCE 96-34 MOTION PAGE 1 OF 3 SECOND 4 "CUNT - l ri( — I>a -, WHEREAS, Public hearings were advertised in the October 30, 1996, November 6, 1996, November 13, 1996 and in the November 20, 1996 editions of The Times of Fountain Hills and Rio Verde, pursuant to Arizona Revised Statutes §9-462.04, and; WHEREAS, Public hearings were held by the Fountain Hills Planning and Zoning Commission on November 14, 1996 and by the Fountain Hills Town Council on November 21, 1996. NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS: Section 1. Pursuant to Chapter 2, Section 2.01 of the Zoning Ordinance for the Town of Fountain Hills, Section 7.03 of the Zoning Ordinance for the Town of Fountain Hills shall be amended as follows: CHAPTER 7 PARKING AND LOADING REQUIREMENTS ,,. 7.03 Design and Location of Parking Spaces. A. Single-Family Residences, Mobile Homes, and Multiple-Family Residences of Four (4) or Less Dwelling Units. *3 1. Location: Required off-street parking shall be located on the same lot or parcel as the use it is intended to serve. Parking lots for model homes may be located on an adjacent lot owned by the owner of the model home. 2. Surfacing: Off-street parking spaces, driveways, and access ways shall be properly surfaced and graded to prevent impoundment of surface water in a manner satisfactory to the Town engineer. Other than single-family detached residential driveways having a slope of less than five percent, all parking spaces, driveways and access ways shall be surfaced with asphaltic concrete, pavement bricks or cement concrete. 3. Driveways: Driveways and access ways shall be not less than ten (10) feet wide for one-way traffic, and not less than twenty (20) feet wide for two- way traffic. C. The use of tandem parking spaces to meet the off-street parking requirements of this Chapter is not permitted in any Zoning District.
