HomeMy WebLinkAboutOrd 1997-09 4 ORDINANCE 97-09 L AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS PURSUANT CHAPTER 2, SECTION 2.01, AMENDING "THE OFFICIAL ZONING DISTRICT MAPS" FOR A PORTION OF PARCEL #12 AND TRACT "C- 3" OF THE EAGLE MOUNTAIN MASTER SUBDIVISION PLAT FROM "OPEN SPACE RECREATIONAL" TO "R1-8A" WHEREAS Chapter 2, PROCEDURES. Section 2.01, Amendments or Zone Changes. establishes the authority and procedures for amending the zoning ordinance; and WHEREAS The Town of Fountain Hills advertised with public notices of a size that were one- eighth page or greater in size, in the official newspaper of general circulation, the Times of Fountain Hills, on February 12, 19, 26, and March 5, 1997, public hearings held by the Fountain Hills Planning and Zoning Commission on February 27, 1997 and by the Fountain Hills Town Council on March 6, 1997, to invite comments from the public; and WHEREAS Parcel #12 of the Eagle Mountain Master Subdivision Plat is zoned "Rl-8A" and therefore allows single-family development; and WHEREAS Tract "C-3" is open space land with the Eagle Mountain Golf Course located on it; and WHEREAS There is a portion of Tract "C-3" adjoining Lots 6, 7, and 8, of Parcel #12 that has been graded but is unused that the property owner, Monterey Homes, desires to have expanded into Lots 6, 7, and 8, of Parcel #12 of the Eagle Mountain Master Subdivision Plat; and WHEREAS Parcel #12 of the Eagle Mountain Master Plat has been amended to expand Lots 6, 7, and 8 to include this unused portion of Tract "C-3". NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS: Section 1.
