AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING THE TOWN
CODE,CHAPTER 12,TRAFFIC,ARTICLE 12-3,PARKING,SECTION 12-
3-8, PARKING OF COMMERCIAL VEHICLES, BY RESTRICTING THE
TIMES DURING WHICH A COMMERCIAL VEHICLE MAY BE PARKED
WITHIN THE PUBLIC RIGHTS-OF-WAY.
BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN
OF FOUNTAIN HILLS, ARIZONA, AS FOLLOWS:
Section 1. That the Town Code, Chapter 12, Traffic, Article 12-3, Parking, Section 12-3-8, Parking
of Commercial Vehicles, is hereby amended by restricting the times during which a commercial vehicle
may be parked within the public rights-of-way to read as follows:
Section 12-3-8 Parking of Commercial Vehicles
No person shall stand or park a vehicle with a rated chassis in excess of 5,000 pounds, gross vehicle
weight or a tractor, semi-trailer, trailer or bus eft a WITHIN THE PUBLIC RIGHT OF WAY IN THE
TOWN BETWEEN THE HOURS OF 9:00 P.M. AND 6:00 A.M.local er col ccto.. strcct in a .widen...,
ene, with the following exceptions:
A. During the process of loading or unloading of such vehicles providing delivery or services withie
the residential area; or
B. During the unloading of personal baggage or temporary stop not to exceed 2 hours.
Section 2. If any section, subsection, sentence, clause, phrase or portion of this ordinance is
for any reason held to be invalid or unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not effect the validity of the remaining portions thereof.
PASSED AND ADOPTED by the Mayor and Common Council of the Town of Fountain
Hills, Arizona this 3rd day of July, 1997.
