AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING THE CHAPTER
13 INDUSTRIAL ZONING DISTRICTS SECTION 13.03 USES SUBJECT
TO SPECIAL USE PERMITS, OF THE ZONING ORDINANCE FOR THE
TOWN OF FOUNTAIN HILLS BY PERMITTING UTILITY SERVICES BY
SPECIAL USE PERMIT ONLY IN THE INDUSTRIAL ZONING
DISTRICTS.
WHEREAS The Town of Fountain Hills adopted Ordinance #93-22, on November 18, 1993,
which adopted the Zoning Ordinance for the Town of Fountain Hills; and
WHEREAS Chapter 2, Section 2.01 of the Zoning Ordinance for the Town of Fountain Hills,
provides for a procedure to amend said ordinance, and
WHEREAS The Town of Fountain Hills desires to permit utility services in the Industrial
Zoning Districts; and
WHEREAS The procedures detailed in Chapter 2, Section 2.01 of the Zoning Ordinance for
the Town of Fountain Hills has been followed; and
WHEREAS The Town of Fountain Hills has advertised the proposed text changes in the
official newspaper of general circulation, The Times of Fountain Hills on
December 24 and 31, 1997 and January 7 and 14, 1998 by showing the addition
of a certain items within the text of Chapter 13, Section 13.03 of the Zoning
Ordinance of the Town of Fountain Hills, in large bold letters; and
WHEREAS The Planning and Zoning Commission's public hearing and the Town Council's
public hearing was advertised in the official newspaper of general circulation, The
Times of Fountain Hills on December 24 and 31, 1997 and January 7 and 14,
1998; and
WHEREAS Public hearings were held by the Fountain Hills Planning and Zoning Commission
on January 8, 1998, and by the Fountain Hills Town Council on January 15, 1998.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. Revisions to Chapter 13, Section 13.03 of the Zoning Ordinance for the Town of
Fountain Hills is amended as follows, with the large bold portions showing the
additions:

INDUSTRIAL ZONING DISTRICTS
Section 13.03 Uses Subject to Special Use Permits
In IND-1 and IND-2 Zoning Districts, the following uses are permitted by special use
permit only:
C. Utility Services, but not including public utility treatment and
generating plants or office, and wireless communication towers
and antennas, unless otherwise specifically permitted elsewhere
in the ordinance.
PASSED AND ADOPTED BY the Mayor and Common Council of the Town of Fountain Hills,
Arizona, this fifteenth day of January, 1998.
