AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING CHAPTER 11,
SECTION 11.10. OF THE ZONING ORDINANCE FOR THE TOWN OF
FOUNTAIN HILLS BY AMENDING THE MINIMUM BUILDING
SETBACK REQUIREMENTS AND INCREASING THE MINIMUM
DISTANCE BETWEEN BUILDINGS IN THE R-2, R-3, R-4, R-5, M-1, M-2,
AND M-3 ZONING DISTRICTS.
WHEREAS The Town of Fountain Hills adopted Ordinance #93-22, on November 18, 1993,
which adopted the Zoning Ordinance for the Town of Fountain Hills; and
WHEREAS Chapter 2, Section 2.01 of the Zoning Ordinance for the Town of Fountain Hills,
provides for a procedure to amend said ordinance, and
WHEREAS The Town of Fountain Hills desires to amend the minimum setback requirements
and the minimum distance between buildings in the M-1, M-2, M-3, R-2, R-3, R-4,
and R-5 zoning districts; and
WHEREAS The procedures detailed in Chapter 2, Section 2.01 of the Zoning Ordinance for the
Town of Fountain Hills has been followed; and
WHEREAS The Town of Fountain Hills advertised in the official newspaper of general
circulation, The Times of Fountain Hills, on December 24, 31, 1997, January 7,
March 4, 11, and 18, 1998, the proposed text changes to Chapter 11, Section 11.10
of the Zoning Ordinance of the Town of Fountain Hills by showing the proposed
changes in large, bold letters; and
WHEREAS The Planning and Zoning Commission's public hearing was advertised in the official
newspaper of general circulation, The Times of Fountain Hills on December 24, 31,
1997, and January 7, 1998; and
WHEREAS The Town Council's public hearing was advertised in the official newspaper of
general circulation, The Times of Fountain Hills on March 4, 11, and 18, 1998; and
WHEREAS Public hearings were held by the Fountain Hills Planning and Zoning Commission
on January 8, 1998, and by the Fountain Hills Town Council on March 19, 1998.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS,ARIZONA AS FOLLOWS:

Section 1. Revisions to Chapter 11, Section 11.10 of the Zoning Ordinance for the Town of
Fountain Hills is amended as shown on Attachment A. The strikeout areas showing deletions and
the large bold portions showing the additions:
