AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS,ARIZONA,AMENDING THE TOWN CODE,
CHAPTER 4, POLICE DEPARTMENT, BY CHANGING THE NAME OF
THE CHAPTER FROM"POLICE DEPARTMENT'TO"PUBLIC SAFETY";
BY CHANGING ALL REFERENCES THEREIN FROM "POLICE
DEPARTMENT 'TO"MARSHAL'S DEPARTMENT';AND BY CREATING
THE POSITION OF"PUBLIC SAFETY DIRECTOR."
BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA, AS FOLLOWS:
Section 1. That the Town Code, Chapter 4, Police Department, is hereby amended by changing
the title of the chapter to "Public Safety"; by amending all references therein from "Police
Department"to"Marshal's Department"; by amending all references therein from"Chief of Police"
to "Town Marshal"; and by creating the position of"Public Safety Director"to read as follows:

ARTICLE 4-1 MARSHAL'S DEPARTMENT
4-1-1 Created; Composition

Section 4-1-1 Created; Composition
There is hereby created a police MARSHAL'S department for the town which shall consist of a chief
of police TOWN MARSHAL and as many peke-officers DEPUTY MARSHALS as may from time
to time be deemed necessary by the town manager for the safety and good order of the town. THE
TOWN MARSHAL SHALL SERVE AS THE "PUBLIC SAFETY DIRECTOR."
Section 4-1-2 Appointment of Officers

the pleasure of the town manager.

Section 4-1-3 Compensation of Officers
The curie€-of police TOWN MARSHAL and the police officers DEPUTY MARSHALS of the town
shall be compensated as determined by the council. The chief of police TOWN MARSHAL shall
not receive any perquisites,commissions or compensation for his services as chief of police TOWN
MARSHAL, except as the council may prescribe.
Section 4-1-4 Departmental Rules and Regulations
The police MARSHAL'S department shall be operated and managed in accordance with such
departmental rules and regulations as may from time to time be adopted by the chief of police
TOWN MARSHAL and approved by the town manager.
Section 4-1-5 Duties of Pellicc MARSHAL'S Department
It is the duty of the police MARSHAL'S department, under the direction of the chief of police
TOWN MARSHAL, to:
A. Enforce this code and the statutes of the State of Arizona within jurisdictional limits as
conferred by law and to arrest and charge the violators thereof.
B. Enforce the traffic regulations of the town as specified in Chapter 12 of this code and enforce
the traffic laws of the state within the limits of the town.
C. Perform such additional duties as may be required by the town manager.
D. Any peace officer or duly authorized agent of the town may stop and detain a person as is
reasonably necessary to investigate an actual or suspected violation of any provision of this
code, and to serve a copy of the traffic complaint for any alleged civil or criminal violation
of this code.
Section 4-1-6 Answering Calls Outside the Town
The members of the peke MARSHAL'S department of the town are duly authorized to answer calls
for aid and assistance beyond the corporate limits of the town pursuant to mutual aid agreements and
state statutes.

ARTICLE 4-2 CONTRACT FOR ADDITIONAL LAW
Low ENFORCEMENT SERVICES
In ADDITION TO ANY LAW ENFORCEMENT
SERVICES PROVIDED BY THE TOWN MARSHAL'S DEPARTMENT,the town may enter into
an intergovernmental agreement or contract for the provision of ADDITIONAL pelice-protection
LAW ENFORCEMENT SERVICES.
Section 2. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for
any reason held to be invalid or unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not effect the validity of the remaining portions thereof.
PASSED AND ADOPTED by the Mayor and Common Council of the Town of Fountain
Hills, Arizona this 2nd day of April, 1998.
