ORDINANCE 98-21
AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA, PURSUANT TO CHAPTER 2, SECTION 2.01 OF THE
ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS, AMENDING
CHAPTER 7, SECTION 7.03.B.6 OF THE ZONING ORDINANCE OF THE TOWN OF
FOUNTAIN HILLS BY AMENDING THE REQUIREMENTS FOR LANDSCAPEING OF
ALL STREET AND ALLEY SETBACKS.
WHEREAS, The Town of Fountain Hills adopted Ordinance #93-22, on November 18,
1993, which adopted the Zoning Ordinance for the Town of Fountain Hills;
and
WHEREAS, Chapter 2, PROCEDURES. Section 2.01, Amendments or Zone Changes.
establishes the authority and procedures for amending the zoning
ordinance; and
WHEREAS, Public hearings were advertised in the April 29, May 6, 13 and 20, 1998.
editions of The Times of Fountain Hills and Rio Verde, pursuant to Arizona
Revised Statutes §9-462.04, and
WHEREAS, Public hearings were held by the Fountain Hills Planning and Zoning
Commission on May 14, 1998 and the Mayor and Common Council on May
21, 1998.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN
OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1, The Town of Fountain Hills Zoning Ordinance, Chapter 7, Section 7.0311.6
shall be amended to require a ten (10) foot landscaped area behind all
street and alley setbacks and allow joint use driveways with Town Engineer
approval as shown in Exhibit"A".
PASSED AND ADOPTED BY the Mayor and Common Council of the Town of Fountain Hills,
Arizona, this 21st day of May, 1998.

CHAPTER 7
PARKING AND LOADING REOUIRTEMENTS
7.03 Design and Location of Parking Spaces
B. All Uses Except as Provided Above.
6. Design: As indicated in the diagram below, all areas of the parking lot with
the exception of necessary points of ingress and egress, shall be no closer
than ten (10)feet from the front property linc all street or alley property lines.
That unoccupied area shall be landscaped and maintained with trees,
shrubs, ground cover, undisturbed natural growth, pedestrian walkways,
and plazas in a manner acceptable to the Planning and Zoning
Commission. Access to off-street parking areas from a public street shall be
from a two-way driveway with a minimum width of twenty (20) feet and a
maximum width of twenty-eight (28) feet, or two (2) one-way driveways
each with a minimum width of twelve (12) feet and a maximum width of
fifteen (15) feet. No access driveway shall be located closer than twenty
(20) feet from a street intersection or other access driveway, nor any closer
than ten (10) feet from any property line unless a joint use access driveway
is approved by the Town Engineer.
