HomeMy WebLinkAboutOrd 1998-24 TOWN OF FOUNTAIN HILLS ORDINANCE #98-24 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, AMENDING CHAPTER 5 OF THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS PURSUANT TO CHAPTER 2, SECTION 2.01 OF THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS TO PROVIDE DEVELOPMENTAL CRITERIA AND REGULATIONS TO PERMIT THE APPROVAL OF GOLF BALL FENCES BY SPECIAL USE PERMIT. WHEREAS, The Town of Fountain Hills adopted Ordinance #93-22, on November 18, 1993, which adopted the Zoning Ordinance for the Town of Fountain Hills, and; WHEREAS, Chapter 2, Section 2.01 of the Zoning Ordinance for the Town of Fountain Hills, provides for a procedure to amend said ordinance, and; WHEREAS, The Town of Fountain Hills desires to amend its regulations to permit the development of golf ball fences by Special Use Permit if certain criteria are met, and; WHEREAS, The procedures detailed in Chapter 2, Section 2.01 of the Zoning Ordinance for the Town of Fountain Hills have been followed, and; WHEREAS, The Town of Fountain Hills has rewritten the text of Chapter 5 of The Zoning Ordinance for the Town of Fountain Hills and published these proposed text changes in the official newspaper of general circulation, The Times of Fountain Hills and Rio Verde on June 10, 17, 24 and on July 2, 1998, and; WHEREAS, Public hearings were advertised in the June 10, 17, 24 and in the July 2, 1998 editions of The Times of Fountain Hills and Rio Verde, pursuant to Arizona Revised Statutes §9-462.04, and; WHEREAS, Public hearings were held by the Fountain Hills Planning and Zoning Commission on June 25, 1998 and by the Fountain Hills Town Council on July 2, 1998. ORDINANCE 98-24 PAGE 1 OF 3 : AS /FAIL -a -fig MOTION _ Seome.ccs,_ SFCOND _r) � _ ' JNT lam'- I ` M* / abs NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS: Section 1. Pursuant to Chapter 2, Section 2.01 of The Zoning Ordinance for the Town of Fountain Hills, Chapter 5 of The Zoning Ordinance for the Town of Fountain Hills shall be amended as follows: CHAPTER 5 5.09 Walls and Fences. A. Height. Golf ball fences may be developed by Special Use Permit if all of the following characteristics apply: 1. Golf ball fences may only be developed on lots that directly abut a golf course or driving range, however, they may not be developed within any front or street-side yard setback. 2. Golf ball fences should only be developed within 600 feet of the forward- most golf course tee box or driving range position. Golf course fences to protect against errant secondary golf shots may be approved due to unusual site or course layout circumstances. 3. Golf ball fences shall be set back from any abutting residential property at a distance not less than the height of the fence. Golf ball fences may be located nearer to such a property line with the prior written consent of the abutting residential property owner. 4. The maximum height of a golf ball fence shall not exceed twenty-five (25) feet. 5. Pole color must blend in with background features as viewed from neighboring properties to minimize its visibility. Net color shall be black. 6. Landscaping should be used where appropriate to obscure the poles from neighboring properties.
