TOWN OF FOUNTAIN HILLS
ORDINANCE 99-11
AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA, PURSUANT TO CHAPTER 2, SECTION 2.01 OF THE
ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS, AMENDING
CHAPTER 8, SECTION 8.03.B OF THE ZONING ORDINANCE OF THE TOWN
OF FOUNTAIN HILLS BY AMENDING THE REQUIREMENTS FOR
SHIELDING/FILTRATION TABLE REGARDING MERCURY VAPOR LIGHTS AND
EXTERIOR LIGHTING.
WHEREAS, The Town of Fountain Hills adopted Ordinance #93-22, on November 18,
1993, which adopted the Zoning Ordinance for the Town of Fountain Hills;
and
WHEREAS, Chapter 2, PROCEDURES. Section 2.01, Amendments or Zone Changes.
establishes the authority and procedures for amending the zoning
ordinance; and
WHEREAS, Public hearings were advertised in the February 10, 17, 24 and March 4,
1999. editions of The Times of Fountain Hills and Rio Verde, pursuant to
Arizona Revised Statutes §9-462.04, and
WHEREAS, Public hearings were held by the Fountain Hills Planning and Zoning
Commission on February 25, 1999 and the Mayor and Common Council on
March 4, 1999.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN
OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
SPrtion 1. The Town of Fountain Hills Zoning Ordinance, Chapter 8 Section 8.03.E of the
Zoning Ordinance of the Town of Fountain Hills Shall be amended by amending
the requirements for shielding/filtration table regarding mercury vapor
lights and exterior lighting as shown in Exhibit"A".

' This is the preferred light source to minimize undesirable light into the night sky
affecting astronomical observations.
2 Metal halide lamps shall be in enclosed luminaries. See also Section 8.04,F.
3 Outdoor advertising signs of the type constructed of translucent materials and
wholly illuminated from within do not require shielding.
4 Warm white and natural lamps are preferred to minimize detrimental effects.
5 For the purposes of this division, a quartz lamp shall not be considered an
incandescent light source.

D. Exterior Lighting. All lighting for off-street parking or loading areas or for
the external illumination of buildings, PARKING AREAS, SIDEWALKS AND of
signs shall be directed away from and shielded from any adjacent
residential property and shall not detract from driver visibility on adjacent
streets. FULLY SHIELDED FIXTURES SHALL BE UTILIZED FOR ILLUMINATION OF
THE AFOREMENTIONED AREAS.
