ORDINANCE # 00-07
AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN
OF FOUNTAIN HILLS, ARIZONA, AMENDING CHAPTER 6 SECTION 6.07 OF
THE ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS PURSUANT
TO CHAPTER 2, SECTION 2.01 OF THE ZONING ORDINANCE FOR THE TOWN
OF FOUNTAIN HILLS TO ADMINISTRATIVELY PERMIT PERMANENT OFF -
PREMISE SIGNS IF CERTAIN CRITERIA ARE MET.
WHEREAS, The Town of Fountain Hills adopted Ordinance #93-22, on November 18, 1993, which
adopted The Zoning Ordinance for the Town of Fountain Hills, and;
WHEREAS, Chapter 2, Section 2.01 of the Zoning Ordinance for the Town of Fountain Hills, provides
for a procedure to amend said ordinance, and;
WHEREAS, The Town of Fountain Hills desires to amend its regulations to administratively permit
permanent off -premise signs if certain criteria are met, and;
WHEREAS, The procedures detailed in Chapter 2, Section 2.01 of the Zoning Ordinance for the Town
of Fountain Hills have been followed, and;
WHEREAS, The Town of Fountain Hills has rewritten the text of Chapter 6, Section 6.07 of The Zoning
Ordinance for the Town of Fountain Hills and published these proposed text changes in the
official newspaper of general circulation, The Times of Fountain Hills and Rio Verde on
February 23, March 1, 8 and 15, 2000 and;
WHEREAS, Public hearings were advertised in the February 23, 2000 and in the March 1, 8 and 15,
2000 editions of The Times of Fountain Hills and Rio Verde, pursuant to Arizona Revised
Statutes §9-462.04, and;
WHEREAS, Public hearings were held by the Fountain Hills Planning and Zoning Commission on
March 9, 2000 and by the Fountain Hills Town Council on March 16, 2000.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
Section 1. Pursuant to Chapter 2, Section 2.01 of the Zoning Ordinance for the Town of Fountain
Hills, Chapter 6, Section 6.07 of The Zoning Ordinance for the Town of Fountain Hills
shall be amended as follows (New text is shown as double -underlined and text to be

6.07 Signs Permitted in Non -Residential Uses in the Following Districts
F. Permanent Off -Premise Suns
Permanent off -premise signs may be administratively approved if all of the following
criteria are met. Permanent off -premise signs:
1. Shall be permitted only in non-residential zoning districts having a zero -foot front or
street side -yard setback.
2. Shall only be permitted if signs are affixed to a building and extend_ over the abutting
Town right-of-way line.
3. Shall only hang over the abutting Town right-of-way line a distance not more than
three (3) feet.
4. Shall not be more than three (3.51 feet wide nor more than six(6)feet high.
5. Shall not be closer than 25 feet to another sign developed under these regulations
whether or not they are on the same lot or parcel.
6. Shall be counted toward the maximum aggregate total area of signs for the site.
7. Shall be located so that the bottom of the sign is not less than eight (8) feet from the
round.
8. Shall not be internally lighted.
9. Shall be limited to not more than two signs per lot or parcel and not more than one
sign per business.
10. Shall be permitted by both a Town sign permit and a revocable Town encroachment
Hermit.
