HomeMy WebLinkAboutOrd 2001-18 ORDINANCE 01-18 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA AMENDING THE FOUNTAIN HILLS TOWN CODE CHAPTER 4, PUBLIC SAFETY BY ADDING ARTICLE 4-4, FIRE PROTECTION SERVICES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, AS FOLLOWS: Section 1. That the Town Code Chapter 4 Public Safety Article 4-4 Fire Protection Service is hereby amended to read as follows: SECTION 4-4-1 FIRE PROTECTION SERVICES FROM AND AFTER THE EFFECTIVE DATE OF THE ADOPTION OF ORDINANCE 01-18 THE TOWN OF FOUNTAIN HILLS SHALL PROVIDE FIRE PROTECTION SERVICES TO ALL OF ITS RESIDENTS WITHIN ITS INCORPORATED BOUNDARIES, AS THEY EXIST NOW OR AS THEY MAY BE AMENDED FROM TIME TO TIME BY OPERATION OF LAW IN THE FUTURE. SECTION 4-4-2 FIRE PROTECTION SERVICES DIRECTOR THE TOWN MANAGER AND/OR HIS DESIGNEE SHALL OCCUPY THE POSITION OF FIRE PROTECTION SERVICES MANAGER AND SHALL BE RESPONSIBLE FOR ALL CONTRACTUAL MATTERS AND PERSONNEL MATTERS WITH REGARD TO THE PROVISION OF FIRE PROTECTION SERVICES TO THE CITIZENS OF FOUNTAIN HILLS. Section 2. That the Acting Town Manager shall prepare for Council approval an alternative plan for full fire service should Rural Metro be unable to provide service. Said plan to be available for discussion and approval at the Special Council Meeting of December 4`h, 2001. Section 3. WHEREAS, it is determined that the public heath, safety and welfare of the citizens of the Town of Fountain Hills would be jeopardized and the financial integrity and viability of fire protection services would be extremely compromised if this ordinance was not passed with an immediate effective date, this is therefore declared to be an emergency ordinance and shall become effective immediately upon its adoption and passage by six or more members of the Town Council of the Town of Fountain Hills, and such emergency measure shall be exempt from the provisions of referendum as set forth in the Constitution and laws of the State of Arizona. Palisades Blvd., Building A Fountain Hills, Arizona 85268 Dear Mayor Morgan: I am a Group President of Rural/Metro Corporation responsible for the operating entity of Rural/Metro Fire Department. Our organization has provided fire protection service to the Town of Fountain Hills for over 25 years, primarily through a contract with the Fountain Hills Fire District. Rural/ Metro is ready, willing, and able to continue service directly to the Fire District. However, should the Town of Fountain Hills elect to exercise its power to provide fire protection service to the Town, this correspondence confirms that Rural/Metro will, and hereby agrees to, provide fire protection to the Town of Fountain Hills in the same vigorous and dedicated fashion as our history reflects. Specifically, RuraUMetro agrees to enter into two separate written agreements, with terms and conditions similar to those contained in the agreements we have shared with the Fountain Hills Fire District. The first agreement would become effective the instant the Town elects to provide fire protection and continue through 11:59:59 p.m. on June 30, 2002. The second agreement, also containing terms and conditions similar to our contract with the Fountain Hills Fire District, will commence on 12:00 a.m. on July 1, 2002 and continue through 11:59:59 p.m. on June 30, 2003. RuraUMetro has always been proud to serve Fountain Hills. We look forward to continuing to protect and preserve this dynamic community.
