AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA, AMENDING THE TOWN OF FOUNTAIN
HILLS ZONING ORDINANCE RELATING TO MAXIMUM BUILDING
LENGTH IN MULTI-FAMILY ZONING DISTRICTS.
WHEREAS, the Town of Fountain Hills (the "Town") adopted Ordinance No. 93-22,
on November 18, 1993, adopting the Town of Fountain Hills Zoning Ordinance (the "Zoning
Ordinance"); and
WHEREAS, Chapter 2, Procedures, Section 2.01, Amendments or Zone Changes, of the
Zoning Ordinance establishes the authority and procedures for amending the Zoning Ordinance;
and
WHEREAS, in accordance with the Zoning Ordinance and pursuant to ARIz.REV.STAT.
§ 9-462.04, public hearings were advertised in the June 8 and June 15, 2005, editions of the
Fountain Hills Times; and
WHEREAS, public hearings were held by the Fountain Hills Planning & Zoning
Commission on June 23, 2005 and by the Mayor and Council of the Town of Fountain Hills on
August 4, 2005.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF
THE TOWN OF FOUNTAIN HILLS, ARIZONA as follows:
That the Town of Fountain Hills Zoning Ordinance, Chapter 11, Multi-Family Zoning
Districts, Section 11.10, Density, Area, Building and Yard Regulations, is hereby amended as
follows:
11.10 Density,Area,Building and Yard Regulations:
The chart, which follows, specifies the minimum lot sizes, minimum area per dwelling
unit, minimum lot widths, maximum building height, and length, minimum yard
setbacks, maximum lot coverage percentages, and minimum distance between buildings.
THE MAXIMUM BUILDING LENGTH APPLIES ONLY TO MULTI-FAMILY
BUILDINGS.
