A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA, APPROVING THE ANNEXATION INTO
THE FOUNTAIN HILLS SANITARY DISTRICT OF A PORTION OF
SECTIONS 1, 2, 3 AND 12, TOWNSHIP NORTH, RANGE 6 EAST OF THE
GILA AND SALT RIVER BASE AND MERIDIAN, COMMONLY
REFERRED TO AS THE "STATE TRUST LAND."
WHEREAS, Fountain Hills Investment Company, LLC, an affiliate of the Elman
Companies ("Ellman"), intends to request annexation of a portion of Sections 1, 2, 3 and 12,
Township North, Range 6 East of the Gila and Salt River Base and Meridian (the "State Land")
into the Fountain Hills Sanitary District (the "District"); and
WHEREAS, Ellman has requested, pursuant to ARrz. REV. STAT. § 48-200(c), that the
Town of Fountain Hills (the "Town") approve the annexation of the State Land into the District
and the Mayor and Town Council of the Town of Fountain Hills (the Town Council") desires to
approve of such annexation.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE TOWN OF FOUNTAIN HILLS as follows:
SECTION 1. That the Town Council hereby approves the annexation of the State Land
into the District.
SECTION 2. That the Mayor, the Town Manager, the Town Clerk and the Town Attorney
are hereby authorized and directed to execute such documents and to take such other and further
actions as may be necessary or appropriate to carry out the purpose of this Resolution.
PASSED AND ADOPTED by the Mayor and Council of the Town of Fountain Hills,
Arizona, December 20, 2007.

requested annexation into the Town of Fountain Hills Sanitary District.

Re: Annexation Request/Fountain Hills State Land Property
Dear Mayor Nichols, Ms. Zanon, and Ms. Bender:
As you are aware, I represent Fountain Hills Investment Company, LLC, an affiliate of
the Ellman Companies. They recently acquired from the State Land Department an
approximately 1,276 acre site located in the northeastern quadrant of the Town of Fountain
Hills. The property lies within portions of Sections 1, 2, 3 and 12, Township 3 North, Range 6
East of the Gila and Salt River Meridian, Maricopa County, Arizona.
Pursuant to Arizona Revised Statute (A.R.S.) §48-262.I, Fountain Hills Investment
Company has requested that the Fountain Hills Sanitary District amend its boundaries to
include the aforementioned property. A copy of the request was provided to you under
separate cover. A.R.S. §48-2001.0 requires the Town of Fountain Hills consent to the
annexation before it can proceed.
We respectfully request that the Town of Fountain Hills consent to this annexation. I
would be happy to provide any supporting documentation that you require to consider this
request.
