AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA, ADOPTING BY REFERENCE THE
"DRAINAGE POLICIES AND STANDARDS FOR MARICOPA COUNTY,
ARIZONA; AMENDING CHAPTER 14 OF THE TOWN CODE
ACCORDINGLY; AND PROVIDING PENALTIES FOR VIOLATIONS."
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS as follows:
SECTION 1. That, pursuant to ARIZ. REv. STAT. § 9 -802, that certain document known
as the "Drainage Policies and Standards for Maricopa County, Arizona" three copies of which
are on file in the office of the Town Clerk and are available for public use and inspection during
normal business hours, which documents were made public records by Resolution 2009 -06, are
hereby referred to, adopted and made a part hereof as if fully set forth in this Ordinance.
SECTION 2. That the Fountain Hills Town Code, Chapter 14, Flood Damage Protection,
Article 14-7, Uniform Drainage Regulations, Section 14 -7 -1, Flood Drainage Regulations, is
hereby amended as follows:
That certain document entitled "
DRAINAGE POLICIES AND STANDARDS FOR
MARICOPA COUNTY, ARIZONA ", sponsored and distributed by the Flood Control
District of Maricopa County, is hereby adopted by the Town of Fountain Hills and made
a part of this Chapter the same as though said regulations were specifically set forth in
full herein; and at least three copies of said regulations shall be filed in the office of the
town clerk and kept available for public use and inspection.
SECTION 3. That any person found guilty of violating any provision of the Fountain
Hills Town Code shall be guilty of a class one misdemeanor. Each day that a violation continues
shall be a separate offense punishable as described above.
SECTION 4. If any section, subsection, sentence, clause, phrase or portion of this
ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the validity of the remaining portions of
this ordinance.
