AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA, AMENDING THE TOWN OF FOUNTAIN HILLS
TOWN CODE, CHAPTER 7, BUILDINGS AND BUILDING REGULATIONS, BY
AMENDING ARTICLE 7-1, TECHNICAL CODES, BY ADDING SECTION 7-1-2
E, AMENDING THE 1997 UNIFORM CODE FOR THE ABATEMENT OF
DANGEROUS BUILDINGS
RECITALS:
WHEREAS, the Town Council desires to amend Chapter 7, Buildings and Building Regulations,
Article 7-1, Technical Codes, by adding to Section 7-1-2 an amendment to the 1997 Uniform Code
for the Abatement of Dangerous Buildings.
ENACTMENTS:
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS as follows:
SECTION 1. The recitals set forth above are hereby incorporated as if fully set forth herein.
SECTION 2. Chapter 7, Buildings and Building Regulations, Article 7-1, Technical Codes, by
adding to Section 7-1-2 an amendment to the 1997 Uniform Code for the Abatement of Dangerous
Buildings as follows:
Section 7-1-2 Amendments
The 2018 Fountain Hills amendments to the 2018 International Building Code, the 2018
International Residential Code for One- and Two -Family Dwellings, the 2018 International Energy
Conservation Code, and the 2018 International Fire Code, AND THE 1997 UNIFORM CODE
FOR THE ABATEMENT OF DANGEROUS BUILDINGS are as follows:
E. THE 1997 UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS IS
AMENDED BY ADDING THE FOLLOWING DEFINITION TO SECTION 302:
19. WHENEVER THERE HAS BEEN A CESSATION OF NORMAL CONSTRUCTION
OF ANY STRUCTURE OR BUILDING FOR A PERIOD OF MORE THAN ONE (1)
YEAR AND THE BUILDING OR STRUCTURE REMAINS UNFINISHED.
SECTION 3. If any section, subsection, clause, phrase or portion of this Ordinance is for any reason
held invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions thereof.
